The attackers' work follows a standard pattern. First, they lure gullible pensioners for a free consultation, instill in them the idea that they have been vilely deceived, litter their heads with legal terms, and then offer help. In order to receive it, you just need to sign. And gullible people sign contracts, under the terms of which they end up owing the “lawyers” very large sums. Most often, people are caught in the legend of an incorrectly accrued pension. The Pension Fund of the Kemerovo Region is simply drowning in illiterately written, uniform applications to verify the accrual of pension payments. In 2020, there were 1,500 such requests, in 2020 their number increased to 3,700, and in three months of 2020, 5,600 requests for pension recalculation have already been registered. None of them have been satisfied yet.

Better from other people's mistakes

The pension was calculated correctly, but the lawyers wrote the letter, which means the pensioner lost his money under the contract. The most annoying thing is that if a pensioner is entitled to recalculation, then he can write an application independently and completely free of charge according to the sample that will be provided to him by the Pension Fund.

Lawyers called Antonina Fedorovna from Novokuznetsk, giving her personal information. The pensioner immediately decided that people were serious if they had such information. She was consulted for free and offered to return her disability pension. For three years, according to callers, she was entitled to 50 thousand rubles. The woman was convinced that the company guaranteed 100% results. They said that just yesterday a similar situation was resolved in court. And while judicial practice has not changed, it is very urgent to draw up an agreement and begin work. The woman transferred the deposit to the lawyers and went to the office, where she signed an agreement for seven thousand rubles. Naturally, she never saw the recalculation or her money again. And when she asked to terminate the contract, they slipped her a piece of paper in which it was written that the pensioner received a paid consultation for the amount paid and had no complaints. Now you definitely don’t have to go to court or to law enforcement officers.

Employees of the law firm came directly to Anna Arnoldovna’s house. The pensioner lives alone in a village house, so she was extremely happy to have guests. So the lawyers grasped at straws and suggested that they punish unscrupulous manufacturers and demand compensation from them for low-quality dietary supplements.

The agreement includes abstract language about the provision of legal assistance, but nowhere is it stated that the “lawyer” is obliged to recalculate the pension payment, much less give any guarantees.

The circuit is debugged

Of course, retirees are pleased to hear that their pension can and should be larger. This is what false lawyers are counting on, as well as the insufficient legal and financial literacy of elderly clients. Additional social tension has been created by the recent pension reform. So our old people are ready to believe in trickery and deception. And in the end they end up in the web of moral monsters (it’s difficult to call them anything else).

Their main task is to force the client to enter into an agreement (for example, to conduct a trial) and extract as much money as possible from it before the deception is revealed. Moreover, the documents are drawn up very competently: the diagrams are tested and verified, the wording is streamlined. The lawyers defended themselves from all sides. Because under these agreements it is impossible to qualify the crime: you yourself signed; you yourself did not read the text of the document; you yourself did not take the time to show it to other specialists or consult with relatives. And it will take a very long time to prove that you were misled and, alas, often to no avail.

“Since 2020, the Pension Fund began to receive applications from citizens filled out using the same template,” said Olga Falaleeva, deputy manager of the Russian Pension Fund branch for the Kemerovo region. – These statements were simultaneously sent to the Pension Fund of the Russian Federation, territorial authorities, the prosecutor’s office, the Commissioner for Human Rights and other organizations. For each application, money was taken from the person. The cost of services under contracts that we have seen ranges from 8 to 30 thousand rubles. It was striking that the applications were often completed with errors. In some places they forgot to change their full name, in others they forgot to change their date of birth. Most of these companies are registered as individual entrepreneurs in Kaliningrad and operate throughout the country. We study every request. Not a single case of violation of pension legislation was identified, everything was calculated correctly. All these issues are resolved with us and completely free of charge.”

In the first quarter of 2019, the Office of the Commissioner for Human Rights received 63 similar appeals of the same standard nature. “These appeals list payments and laws that do not relate to pensions at all,” explained Anna Abramova, leading consultant and legal adviser to the office of the Commissioner for Human Rights in the Kemerovo Region. – We also deal with such requests completely free of charge. Check it seven times, sign it once

“As a rule, those affected by the actions of such offices do not reach qualified lawyers and do not receive help,” noted Elena Larina, a human rights lawyer, member of the Public Council at the Main Directorate of the Ministry of Internal Affairs of Russia for the Kemerovo Region. “If a person is deceived by one lawyer, he stops believing everyone else.”

Before signing any legal agreement, Elena Aleksandrovna advises, first of all, to ask the specialist who works with you to present a diploma of legal education. There is nothing wrong with this, and the document must be located at the place of work. You should also clarify where the organization is registered, who is its leader, and ask to look at court decisions with the name of the executor. It may turn out that the lawyer you are working with has no judicial practice at all. Next, you must read the text of the contract and understand what lawyers undertake and do not undertake to do. It is the contract that determines the volume of services for which a person pays. And it is the contract that is the document with which you will then have to go to court. Don't believe the words, believe the papers. If the contract says “paid consultation” and you were not provided with it, then you are being deceived. Do not believe when they tell you “yes, it’s the same” or “it’s all the same”, “it doesn’t matter” when they are spoken in relation to a contract. Everything is important there. You should not let the document you are signing out of your hands, and if you released it and handed it to a specialist to enter personal data, re-read it again before signing. This may be a completely different document than the one with which you were previously familiarized.

“But the problem with pensioners is that they don’t read, they listen,” Elena Larina continued. - And they trust. Remember that despite all beliefs about the urgency of the issue, there is no need to sign an agreement here and now. A reputable organization will easily give you a sample contract so that you can study it in a calm atmosphere and discuss it with other lawyers or relatives.”

Of course, it is not easy for a pensioner to conduct his own investigation and bring cunning businessmen to light. But everyone can consult with children, relatives, or take someone with them to a meeting. The main thing at this moment is to include a second person in the process. It is much more difficult to deceive two people than one. And children should conduct an educational program for their elderly parents on the topic of legal fraud and rules of conduct in such a situation. “Punish, ask, control - do everything to be able to stop your loved one from rash actions in time,” said Olga Rubleva, head of the Helpline service. – Yes, there is a category of authoritarian pensioners who are difficult to force to consult with someone. Act with cunning, find solutions. But the responsibility for their mistake will be on you, the children.”

Perhaps a hotline for consultations on this issue based in some department could help in solving this problem.
