The Russian government will increase pensions for former employees of the Ministry of Internal Affairs

Pensions have always been and remain the most pressing social issue. As of 2020, there are over 42 million pensioners in our country. These are only civilians. According to the Ministry of Defense, the number of military retirees is about 1.1 million people.

Since the specifics of the work of employees of the Ministry of Internal Affairs are somewhat different from those of civilians, their pension is calculated differently. Also, funding comes from the Ministry of Internal Affairs, and not from the pension fund.

Pensions for employees of the Ministry of Internal Affairs are assigned based on the following: length of service, acquired disability and a pension in connection with the loss of a breadwinner.

How are pensions calculated for employees of the Ministry of Internal Affairs? It includes the amount of salary that the employee had before dismissal, the presence of a title for which there was additional payment. This also includes additional payments for long service and monthly compensation for food in cash terms.

Thus, if, say, a police officer has more than 20 years of experience, his pension will be calculated based on half of the full years of service and adding 3% to them for each subsequent year.

As for a disability pension, an employee of the Ministry of Internal Affairs can receive it if he received this disability either during his service or in the next 3 months after it. To assign such a pension, a medical examination report will be required.

A survivor's pension can be received by minor children, as well as the spouse and parents supported by the employee. Moreover, the pension is assigned in the event of his death either during the period of service, or after it, but as a result of injury in this service. In the first option, the monthly compensation will be 50%, in the second - 40%.

What is pension provision for employees of the Ministry of Internal Affairs

Police service is associated with risk on a daily basis, even life-threatening, irregular schedules and other important factors. Due to these circumstances, the appointment and accrual of pension benefits to persons who have worked in this field are different from the conditions for pension payments to other Russians. In addition, each pensioner of the Ministry of Internal Affairs has his own special benefits.

The purpose of pension provision is, as a rule, determined by length of service, which is provided for at the legislative level. To qualify for pension payments based on length of service, a person working in the police must have twenty or more years of work in the Ministry of Internal Affairs. When the age limit for service in the authorities is reached and a person does not have the specified length of service, in order to assign a pension based on length of service, compliance with the following provisions is necessary:

  • reaching 45 years of age or having health restrictions that do not allow full further service;
  • the final work experience is 25 years, while service in internal organs is at least 12.5 years.

Since the assignment of military pension benefits occurs regardless of age, people become such pensioners much earlier than civilian recipients of social security insurance. In addition, a military pensioner who is able and willing to work can get a job, begin accumulating pension points and then receive an additional old-age pension upon reaching the required age.

The amount of accruals is based on the amount of monetary allowance, while the minimum amount is determined by the social pension. Monetary allowance is a serviceman’s earnings, consisting of salary and various supplements taken into account during annual indexation. According to Law No. 306-FZ, bonuses are provided from the salary as a percentage for:

  • length of service – 10-40% monthly;
  • class – 5-30% monthly;
  • work with classified data – up to 65%;
  • special dangerous conditions and special achievements – up to 100% monthly;
  • conscientious service - up to 300% annually.

Does the size of the pension depend on salary?

The allowance for former employees of the Ministry of Internal Affairs consists of several components:

  • experience in the police;
  • salary amount for the position at the time of registration;
  • rank allowances;

A reduction factor is calculated from the official salary. Initially, it was planned to gradually increase it.

However, for several years it was suspended and since 2016 the coefficient has been 69.45% and has not increased. The level of payments depends on the region, the laws adopted there and the current benefits and allowances for law enforcement officers. The entire amount of the benefit, together with bonuses, cannot exceed 85% of the salary. The increase in pensions for employees of the Ministry of Internal Affairs will also occur due to an increase in the coefficient.

From this year it will be 72.23% . In addition, since the beginning of the year, the government has indexed the salaries of public sector employees, police salaries have increased by 4% , and accordingly, payments to those who will retire this year will increase by the same amount.

An increase in pensions for Ministry of Internal Affairs pensioners who have received long-service benefits but are still working will occur only by increasing the reduction factor and points for length of service. However, from the moment they decide to leave the service, they will begin to receive an insurance pension with all the required allowances and indexation already made. If after some time he starts working again, his benefit amount will not decrease.

Regulatory framework

The right to receive pension payments from the state by employees of the Ministry of Internal Affairs is provided for both by the main legislative pension act, which applies to all citizens, and by legal norms relating to specific groups of people - military personnel, to which ordinary and commanding persons who served in the Russian internal affairs bodies are equated. Guided by the following standards:

  • Federal Law of December 15, 2001 No. 166-FZ “On state pension provision in the Russian Federation” (Articles 3, 4, 8, 25);
  • Federal Law dated December 28, 2013 No. 400-FZ “On insurance pensions”;
  • Federal Law No. 424-FZ dated December 28, 2013 “On funded pensions”;
  • Federal Law of November 30, 2011 No. 342-FZ “On service in the internal affairs bodies of the Russian Federation and amendments to certain legislative acts of the Russian Federation” (Articles 11, 38, 70);
  • Federal Law of July 19, 2011 No. 247-FZ “On social guarantees for employees of internal affairs bodies of the Russian Federation and amendments to certain legislative acts of the Russian Federation”;
  • Federal Law of February 12, 1993 No. 4468-1 “On pension provision for persons who served in military service, service in internal affairs bodies, the State Fire Service, authorities for control of the circulation of narcotic drugs and psychotropic substances, institutions and bodies of the penal system, national troops Guards of the Russian Federation, and their families";
  • Decree of the Government of Russia dated September 22, 1993 No. 941 (as amended on December 15, 2017) “On the procedure for calculating length of service, assigning and paying pensions, compensation and benefits to persons who served in military service as officers, warrant officers, midshipmen and military personnel of extended service or contract as soldiers, sailors, sergeants and foremen, or service in internal affairs bodies, the federal fire service of the State Fire Service, institutions and bodies of the penal system, troops of the National Guard of the Russian Federation, and their families in the Russian Federation";
  • Decree of the Government of the Russian Federation dated November 3, 2011 No. 878 “On establishing monthly salaries for employees of internal affairs bodies of the Russian Federation”;
  • Decree of the Government of the Russian Federation dated December 21, 2017 No. 1598 “On increasing the salary of military personnel and employees of certain federal executive authorities.”

How much will pensions increase?

Pensioners of the Ministry of Internal Affairs of the Russian Federation in 2020 expect an increase in pensions from October 1, 2019. In total, indexation will be 7.75%. It will consist of several parts.

According to Art. 43 of the Law of the Russian Federation No. 4468-I of February 12, 1998. Pensions assigned to retired police officers are calculated from the salary of persons on duty.

According to the provisions of the Order of the Government of the Russian Federation No. 415-r dated March 13, 2019. the indexation of wages for employees of internal affairs bodies is provided for from October 1 by 4.3%.

Separately, at a meeting with the President of the Russian Federation, it was decided to increase pensions by 2% and this norm is included in the law on the Federal Budget for the next two years. In addition, pensions will increase due to the fact that the percentage of monetary allowances for calculation has been increased.

Types of pensions in the Ministry of Internal Affairs

The purpose of a pension depends on its type and basis. Currently there are pensions for long service, disability and loss of a breadwinner. In addition, those who continue to work have the opportunity to earn an insurance type of pension. Injuries and illnesses acquired during service are grounds for receiving disability pension guarantees, regardless of length of service.

The amount of pension payments is calculated based on the disability group determined by a medical and social special examination. Persons who received disability while working in the Ministry of Internal Affairs, or within three months after dismissal, can count on this. For such a pension, disability that occurs later must be due to circumstances that occurred during the period of service in the internal bodies of the Russian Federation. Taken into account:

  • wound, trauma;
  • contusion;
  • injury, damage;
  • disease.

Pension payments based on the loss of a survivor are provided to the families of employees who died/died during the period of service (within three months after dismissal). If the breadwinner died after three months, the payment is given due to the cause of death - injury, illness received while in service. Most former police officers, having received a departmental pension, now work in civilian jobs or as civilian employees in their own department.

In this case, the employer pays pension insurance contributions for them and, in accordance with Law No. 400-FZ, these persons acquire the right to an insurance pension with continued pension payments from the Ministry of Internal Affairs, subject to the following conditions in 2020:

  • reaching 60 years old (men), 55 years old (women);
  • the value of the individual pension coefficient (IPC) equal to 13.8 points or more;
  • duration of insurance period is 9 years or more.

Conditions of appointment

The regulatory legal act stipulating the conditions for the right to pension payments based on length of service (experience) is Law No. 4468-1. This type of payment is assigned under the following conditions:

  • Sufficient length of service. To receive a pension according to length of service (required length of service), you must work in law enforcement agencies for at least 20 years.
  • The maximum age is 45 years for a person/inability to work due to health. If an employee was dismissed/reduced before twenty years of service, his pension right is retained when his duration of employment is 25 years or more, and the period of employment in the Ministry of Internal Affairs is no less than 12.5 years. Conditions for receiving a pension from the Ministry of Internal Affairs

Employees of the Ministry of Internal Affairs, like the military, are also civil servants. However, given the complexity of the work they perform, which often involves risks to health and even life, the government has developed a number of incentive measures that can compensate for the difficult conditions of service. In particular, all law enforcement officers have the right to receive a long-service pension. To do this, the following conditions must be met:

  • From this year, the retirement age has been raised by a year and should be 46 years old ,
  • work experience in authorities - 20 years .

If, upon reaching this age, a person has not accumulated the required work experience in the Ministry of Internal Affairs, then he can still apply for benefits if his total work experience is 25 years , and he has worked in the police for at least 12.5 years .

It is planned to increase seniority as gradually as age. This takes into account:

  • years of military service,
  • studying at a university,
  • time spent working in government agencies.

Employees of the traffic police and transport police, all police departments (federal and regional throughout Russia), special forces military personnel, the National Guard, operational investigative and search units, investigative bodies, departments of the Federal Migration Service and the Federal Service for Turnover can count on a long-service pension from the Ministry of Internal Affairs for drug control and other units related to the Ministry of Internal Affairs. Participants in combat operations and anti-terrorist operations, including for service in the North Caucasus, and for their courage in detaining especially dangerous criminals, receive special pension supplements.   • minimum work experience - 9 years ,
  • accrual of the required amount of insurance points on an individual personal account in the Pension Fund - this year they should be 13.8 points .

Pension for MFD employees in 2020 according to length of service

Employees of the Ministry of Internal Affairs are treated as military personnel on a par with those serving in the army and the FSB. The Ministry of Internal Affairs pension in 2020 is formed on the same basic principles for the formation of payments as for the previous year 2017. The following parameters are used to calculate the amount:

  • employee experience, including mixed work experience;
  • job title;
  • rank;
  • allowances during service;
  • salary;
  • qualification.

Who will have their pensions increased?


Citizens discharged from military or equivalent service (Ministry of Internal Affairs, Ministry of Emergency Situations, Federal Penitentiary Service, etc.) can count on increased pensions.
That is, we are talking about increasing the pensions of all military personnel, and not just pensioners of the Ministry of Internal Affairs. The legislation does not provide for any provisions for extending pension increases to certain categories of military personnel or employees of the Ministry of Internal Affairs. Section II of Law No. 4468-1, which determines the pension provision of military personnel, provides such a right for the following persons:

  • 3% of the required salary - for each annual service period of more than 20 years (within the maximum value of 85% of these amounts);
  • with a service duration of 12.5 years with a total work experience of 25 years - 50% of the salary and 1% for each year of work over 25 years.

When going on statutory rest, the length of service of a law enforcement officer includes time spent working in other law enforcement agencies. Service for certain periods is counted according to a grace period, for example, such as:

  1. performing duties in a zone of military operations (conflicts);
  2. participation in counter-terrorism activities in the North Caucasus;
  3. criminal investigation service, etc.

For 2020, it is planned to index the pensions of employees of the Ministry of Internal Affairs in the amount of 4%. Allowances

The size of the pension for law enforcement officers is affected not only by salary, there are also allowances. The sizes of allowances to the base part are as follows:

  • 100% – for elderly 80-year-old persons with disability of the 1st group;
  • 32% - for 1 dependent, 64% - for 2, 100% - for 3 or more - for pensioners supporting disabled people in the family;
  • 32% - to participants of the Second World War and combat operations; from 80 years of age this amount is 64%;
  • from 40 to 85% – for disability (the rate is determined by the group and reasons, i.e. the origin of the loss of health);
  • 85% – in case of injury resulting in disability (within 130% of the basic pension).

How is recalculation done?

The size of the pension depends on the total payments accrued during the period of service. If the size of these payments increases, it becomes possible and rational to carry out a recalculation. But due to the difficult economic situation in the country and a decrease in contributions to the budget revenues, the government is discussing the possible abolition of indexation, various payments and allowances.

According to Federal Law No. 4468-1, indexation of insurance payments should be made annually: February 1 – to the inflation rate; April 1 - at the discretion of the Pension Fund of the Russian Federation.

Any component can affect the amount of the pension, but the most important determining factors are the position and title of the person working in the Ministry of Internal Affairs.

Insurance pension

Often pensioners, former police officers, continue to work in civilian structures. Having reached the generally established age limit for an old-age pension, under certain conditions they can exercise their right and receive an insurance pension on the basis of “old age” simultaneously with the previously assigned departmental support through law enforcement agencies. Payment from the law enforcement department is determined by Law No. 4468-1 and is carried out in full, regardless of the continuation of the pensioner’s work activity.

If a former employee of the Ministry of Internal Affairs already has two pensions and is working, then the provision of both military personnel and insurance pension payments occurs in full, and according to Law No. 385-FZ, the indexation of payments from the Pension Fund is suspended for the duration of the pensioner’s work. The opportunity to receive an insurance pension for a pensioner of the Ministry of Internal Affairs is given upon reaching the general civil retirement age (in 2020, 60 years for men, 55 years for women). The IPC in 2018 must be ≥ 13.8 points, and for insurance coverage you must work for at least 9 years.

In accordance with the transitional legal provisions on insurance pensions, the IPC, necessary for military pensioners to form the insurance part of the old-age pension, annually adds 2.4 units, and by 2025 it will reach thirty points. The insurance period required for this case increases by one year each financial period to a value of 15 years by 2024.

Has the 2nd pension been indexed?

General and special pension legislation for employees of law enforcement agencies and law enforcement agencies allows for the payment of two pensions to former police officers, and in some cases to family members of a deceased employee of the Ministry of Internal Affairs.

This is due to the fact that the law does not prohibit such a person, after dismissal from service in the Ministry of Internal Affairs due to length of service, to receive departmental support while continuing to work in “civilian” positions. In the process of such activity, this person can earn the right to a general old-age pension (for this it is only necessary to have a minimum amount of insurance coverage and the level of the individual pension coefficient).

In this case, both types of security are paid and increased independently of each other . This means that the old-age pension is indexed on the same basis as for all other citizens. With such a second pension, it was also increased by even more than the inflation factor. The growth rate of the second payment through the Pension Fund of the Russian Federation was 7.05%.

Important! The growth rules for both pensions also apply to family members of a deceased or deceased employee (including a former employee). Indexation of the size of the insurance pension should not in any way affect the possibility of indexation of departmental payments.

Have payments to working pensioners of the Ministry of Internal Affairs increased?

After dismissal from the internal affairs bodies, a former police officer has the right to continue to carry out labor or entrepreneurial activities. At the same time, he does not lose the right to a pension from the Ministry of Internal Affairs.

But its payment is suspended if they have entered into a contract for military or other equivalent service. Upon termination of such service, payments will resume. If any indexation occurred during this time, he will receive payments in an increased amount.

As for the general civil old-age pension, 2020 was also no exception in the series of the last few years when working pensioners were not included in the list of persons to whom payments were indexed.

The indexation that occurred from January 1, 2020 will affect working pensioners only when they cease their activities and retire . This is also relevant for the second pension of a former employee of the Ministry of Internal Affairs who is working in a given year under an employment contract or as an individual entrepreneur.

By disability

A pension on this basis is assigned for the period of disability (which is determined by a special medical commission) and for life if the disabled person has reached the general retirement age (60/55 years). In accordance with Section III of Law No. 4468-I, a pension on the basis of “disability” is provided:

  • for military trauma: Group I, II – 85%, Group III – 50% of the allowance under Art. 43 of the noted Law;
  • for a disease acquired during military service: Group I, II – 75%, Group III – 40% of monetary allowance.

How are pensions of the Ministry of Internal Affairs formed?

Employees of the Ministry of Internal Affairs (hereinafter referred to as the Ministry of Internal Affairs) are most often granted a pension based on length of service. However, the procedure for calculating and forming a pension benefit differs from receiving regular pension payments. Employees of the Ministry of Internal Affairs have a number of benefits upon retirement, since their activities are directly related to risks to life, irregular work schedules and other factors. The retirement procedure largely depends on what type of pension is assigned to the former employee of the Ministry of Internal Affairs. Pensions are currently being allocated:

  • by length of service;
  • by disability group;
  • for the loss of a breadwinner.

Conditions for applying for a pension:

  • direct labor activity in authorities - 12.5 years;

  • monetary certificate;

When forming a pension related to disability, it is necessary to additionally provide a certificate from a medical expert commission, which identifies one of three groups. When forming pension contributions to the relatives of the deceased, you must additionally submit to the Pension Fund: a document confirming the fact of death of an employee of the Ministry of Internal Affairs; decision of the judicial authorities to declare a close relative missing; an extract from the order to exclude the deceased from the Ministry of Internal Affairs; documents on relationship with a former employee of the Ministry of Internal Affairs; an investigation document related to identifying the cause of death; conclusion of the military medical commission (briefly MMC).

For the loss of a breadwinner

Pension provision for the loss of a breadwinner is provided if the breadwinner, an employee of the Ministry of Internal Affairs, died/died while serving, either within three months after dismissal, or at any time after dismissal due to illness or injury received in the service. In this situation, the right to pension assistance is given to his disabled relatives who were in the care of the deceased. These are children in full-time education up to 23 years of age; disabled people; pensioners - parents, spouse; a relative who is raising the children/brothers/grandchildren of the deceased. These include:

  • mother/wife over 55 years old;
  • father/husband over 60 years old;
  • mother/father/spouse – disabled people of any age;
  • minor children;
  • minor brothers/grandchildren without able-bodied parents;
  • disabled since childhood (children/brothers/grandchildren);
  • full-time students/siblings/grandchildren aged 18-23;
  • unemployed close relatives of any age and ability to work, engaged in raising minor (under 14 years old) children/brothers/grandchildren of the breadwinner.

The amount of social payments is as follows:

  • 50 percent - for each disabled relative (family member) of a serving person who died due to a military injury;
  • 50 percent - for a child left without parents/single mother - pensioners with a disability due to a military injury who died for any reason;
  • 40 percent - for each disabled relative (family member) of a serving person who died due to reasons unrelated to service.

If the annual budget deficit continues to be the same or higher, interest rates will increase, as will pressure on the economy, and government spending will also increase. This may mean that proposals made but not adopted in previous years will be given more serious consideration.

In 2020, the situation will not change yet in the area of ​​economic development of the country; there is still a budget deficit, and accordingly, the size of pensions even for employees of the Ministry of Internal Affairs has nowhere to increase.
