All working citizens who have earned work experience for a well-deserved rest acquire the right to receive social security. However, there are categories of employees who are entitled to benefits upon retirement. This depends on the type and conditions of the activity they carry out. The procedure for processing such a payment is stipulated by law and has its own peculiarities. It is important to know what documents are needed to apply for a preferential pension, and when is the best time to start collecting them.

Who retires earlier than others?

The right to stop working early and receive a pension has been granted to a large number of citizens of the country. These include mothers with many children, welders, and miners. In short, more than 21 categories, not counting workers in the Far North, equivalent regions, and many other “beneficiaries”.

Lists of jobs that require early retirement are given in 400-FZ “On Insurance Pensions” and some other laws. The Lists approved by the USSR Cabinet of Ministers in 1991 are also in effect. But applying for a pension based on preferential service or on other grounds is unified and will not be very difficult. Let's look at this process in more detail.

Procedure for applying for benefits

After the pensioner has submitted a request for benefits and received a positive response, the educational institution enters into an agreement with the utility company that provides services at the applicant’s place of residence.

Based on this agreement, the utility company will send monthly bills to the educational institution for payment.

If there are other beneficiaries in the pensioner’s family, then only one of them will be able to receive social assistance for utilities, and it is up to the applicants themselves to decide for whom the benefits will be issued.

How to prepare

The key to timely assignment of a pension, taking into account all pension rights, is detailed preparation. Basically you will need:

  • consultation with a lawyer who will tell the citizen about his rights and help him decide on the set of documents relevant in his case;
  • collection of necessary documents that confirm the development of experience;
  • requests to archival organizations and the Federal Tax Service, if any internship documents or information on salary before 2002 are missing;
  • collection of documents that determine the exclusive right to early retirement - relevant only to certain categories of “beneficiaries” (mothers of large families, “Northerners”, etc.);
  • registration with the Pension Fund for advance registration of a pension.

All necessary activities should be started at least 2 years before the expected retirement date. At the same time, you should register with the Pension Fund for advance preparation no later than 6 months before the actual date of assignment of pension benefits.

Definitions

The required pension provision is paid to citizens who have not yet reached retirement age. The minimum age for receiving old-age benefits is 60 and 55 years for men and women, respectively. The procedure for registration and calculation of pensions is determined by the provisions of the Labor Code of the Russian Federation.

In most cases, citizens are paid an early pension five years before reaching the statutory retirement age. However, the specific period is determined individually, since it depends on the profession of the pensioner.

Contacting the Pension Fund

Registration of a preferential pension according to the list involves the use of all rights of a citizen, including early application to the Fund. Registration of a pension in advance greatly simplifies the end of work (or simply the assignment of pension benefits). 1-2 years before retirement, consultation with the Fund is requested. During the consultation, the collected documents are submitted, and the date of retirement is also indicated.

Pension Fund specialists formulate a pension case, or rather its project. In the future, it will significantly simplify retirement, and in addition, some certificates will not have to be taken out again, because they will already be in the fund.

Types of pensions

The modern pension system of the Russian Federation is represented by the following types of pensions:

  • insurance;
  • state;
  • cumulative;
  • non-state.

All pension funds are formed from contributions that are accrued monthly to the wage fund of workers or employees. The size of these contributions is 22% of the accrued salary. In turn, the received amount of contributions is divided into two parts: insurance and savings. However, for some types of activities, accruals are made at a reduced rate, but for workers employed in complex and hazardous industries, an additional tariff is added to the established rate.

The insurance or first part of pension funds is deposited in the personal accounts of citizens, and is adjusted annually by the inflation index. Current pensioners receive their payments from these funds. The second smaller part of the pension is accumulated by law in the accounts of working citizens born in 1967 and later. State benefits are assigned to citizens who worked in the federal service in government agencies, or to non-working persons who for some reason cannot qualify for a labor pension.

Non-state pension provision refers to voluntary insurance of citizens.

What documents will be required?

Basically, a citizen must provide the following basic documents:

  • identification;
  • SNILS (this is a green card issued by the Pension Fund of Russia in Russia to all insured persons, including children);
  • documents on length of service (work book) and salary for any 60 months before 2002;
  • Certificate of change of name (if changed);
  • Certificate of marriage, divorce (if this happened);
  • Military ID (for citizens liable for military service);
  • Birth certificates of children (if any);
  • Confirmation of caring for a disabled person or a citizen over 80 years of age (if available).

But what documents are needed to apply for a preferential pension is one of the frequent questions that lawyers hear during consultations. Many “beneficiaries” believe that they need to confirm their rights in some special way.

In fact, information about the right to early retirement is almost always taken from experience documents, which include:

  • work book – the main “working” document;
  • employment contracts, contracts, civil contracts, especially fixed-term ones;
  • copies of orders on employment and dismissal, job transfers;
  • route sheets, pay sheets and other internal personnel, accounting and other documents of the enterprise where the citizen worked.

But in some cases, “special” documents will be required. This is the conclusion of a special commission recognizing working conditions as harmful (for example, for drivers). A certificate from the employer may be required, which substantiates the impossibility of using less harmful production. In some cases, certificates from the municipality may be required (for example, in the case of “Severyan”).

Regulation of the field of education is carried out within the framework of labor, constitutional (the right to study) and administrative legislation.

If there are no documents about experience

If there are no documents on special or general experience before 2002, information can be obtained from the employer in the personnel and accounting department. If the company has already closed, but it has a legal successor, the corresponding certificate will be issued by the accountant and personnel officer of the new company. If there is no legal successor, you will have to request information from the archive.

But situations often arise when the archive refuses to issue information because it does not have the appropriate documents. In such cases, citizens can either look for 2 witnesses who worked with them during the disputed period.

There is another way - to establish length of service in court. The fact is that the courts have the authority to request, among other things, classified information from the tax office and the Pension Fund of the Russian Federation. Consequently, if the company made tax deductions for the employee, then on their basis it will be possible to restore both the length of service and calculate the salary.

Benefits for teachers on utility bills

This benefit is provided to retired teachers.

Teachers are reimbursed for:

- for rent,

– for hot and cold water,

– electricity (according to consumption standards established by regions),

– central heating or gas (as per standard or according to meter readings);

– solid fuel – coal, firewood (according to consumption standards).

Since 2013, utility bills have been compensated according to average indicators, and the cash payment is 1,200 rubles.

Where to contact

Registration of an early insurance pension in Russia is carried out exclusively at the Pension Fund of the Russian Federation. You can submit an application and a package of documents to the territorial Pension Fund Client Service at your place of residence or stay. If there is none, the application is made to the Pension Fund Office for the locality, district, region where the citizen lives or stays.

Alternatively, documents can be sent to the Fund either through the MFC or by mail. If a citizen applies for an early pension via the Internet (via State Services or the Pension Fund website), the application will be accepted electronically, but the documents will have to be submitted either by mail or in person to the Fund or the Multifunctional Center.

The period for consideration of the application is 10 days. The pension is paid from the day the citizen applies, but not before the right to a pension arises. Documents are submitted no earlier than 1 month before the appointment of pension benefits.

Rules for calculating length of service for preferential pensions for teachers

The teaching experience includes the following periods:

  • work under a contract in accordance with which deductions were made;
  • vacation that the teacher used annually;
  • benefits related to temporary disability;
  • leave to care for a child up to 3 years old (until October 6, 1992);
  • period of study at a university, if teaching activities were carried out before and after it (before October 1, 1993).

Moreover, the teacher’s work activity is included in the teaching experience only if the required workload is completed. In a village it can be less than 18 hours.

If a part-time worker works the required number of hours, then he can retire on preferential terms. The standards for hours of teaching work, depending on the position, can be found in Order of the Ministry of Education and Science of Russia dated December 24, 2010 N 2075. It is recommended that a few months before the expected retirement, you make a request to the Pension Fund for a personal account extract in order to check whether all periods of work are available there, so that time to correct any misunderstandings.

But, despite all the efforts made by the future pensioner, the Pension Fund may not count some of the periods of work. For example, the work of a pioneer leader. The procedure for calculating years for preferential length of service and the list of positions for which this length of service can be applied has changed several times over the past decades. It must be taken into account that periods of work in a position that is not currently in the list of teaching positions could be included in previous regulations and can be counted towards teaching experience.

Thus, some professions associated with publicly appointed positions simply disappeared after the new list of 1993. But they can be counted provided that the remaining 2/3 of the teaching experience has been worked in the relevant positions established by law at the time of registration of the pension.

There is another interesting feature when calculating length of service for this type of preferential pension: if it was accumulated before 01.10.1993, the teaching and medical experience for calculating the preferential pension can be summed up. The requirements for calculating the length of service in question also changed in 1999 and 2002.

This must also be taken into account when applying for a pension, as well as the fact that the laws will be applied sequentially over time to the future pensioner. Previously existing laws are not mandatory, but most often at the request of the citizen himself.

The incentive part includes:

– bonus for additional workload in specialized classes and groups,

– additional payment for harmfulness (chemistry teachers),

– bonus for class (class teachers),

– additional payment for special work hours,

- financial assistance.

  1. Personal visit to the Pension Fund.

The faster assignment of an old-age pension depends on the correctness of the completed application. If errors or corrections are identified in this document, Pension Fund employees have the right to refuse to accept documents until the application is rewritten.

Legislative regulation of the issue

Federal Law No. 173 states that citizens whose work meets the following conditions :

  1. The transfers are sufficient for the funded part of the pension.
  2. Citizenship of the Russian Federation.
  3. Permanent registration in one of the regions of Russia.
  4. Availability of insurance in the state pension system.

A certain age, combined with compliance with the requirements described above, insurance coverage and work under special conditions, gives the right to early retirement.

In total, representatives of 24 professions can count on early, well-deserved rest, in accordance with the list adopted by the Government.

Any citizen who has worked under special conditions has the right to receive a preferential pension. All necessary information can be found in Art. 30 and 31 of the federal law “On insurance pensions”.
