Who is entitled to a military pension?

To whom, how, in what amount and under what conditions a military pension is assigned - all these issues are reflected in Federal Law No. 4468-1 of 02/12/1993. Article 1 of the law defines the categories of citizens who can apply for this pension. These include military personnel who served (served) in the internal affairs bodies, the national guard, the FSB, the penal system, in departments involved in drug control, and in the fire service.

All these military rank and file and commanding officers are subject to the law if they served during the USSR and at the present time. Pensions are also provided to military families who have lost their breadwinner.

Types of military pension

In Russia, there are 3 types of military pensions:

  • Pension for military personnel based on length of service does not depend on age, so 30-year-old military personnel can receive such a pension. Its size is influenced by where, under what conditions, in what rank, how and how many years the serviceman served;
  • Pension for military disability pensioners The right to it appears for those military personnel who became disabled during service;
  • Military survivor's pension Available to families of military personnel who died while serving.

Who receives military pensions and how much?

Military pensioners receive pensions according to different rules than ordinary ones. So, if “civilian” pensions are assigned based on pension points and a fixed payment (which are indexed annually), then the military’s pension depends on three things:

  • monetary support for active military personnel (appropriate rank and position);
  • length of service - the longer the length of service, the greater the percentage of the monetary security the pensioner receives;
  • The reduction factor is the same for everyone, and it is established by federal law. Now the coefficient is 0.7368.

The main category of military pensioners are former contract servicemen who retired due to length of service. The minimum length of service for a pension is 20 years

(for this a pension of 50% of the salary is given), but for each year beyond this, the pensioner is added 3% of the salary (but not more than 85%).

And if a pensioner has a mixed length of service (military service and civilian work), then he can receive a military pension with at least 12 and a half years of service

, and the total experience is at least 25 years (for this the same 50% of the salary is given). For each additional year of total service, such pensioners receive an increase of 1% of their salary.

In addition, there are other types of military pensions:

  • for disability - depending on the circumstances of receipt of disability and its group, they receive from 40 to 85% of the monetary allowance;
  • for the loss of a breadwinner - 40% or 50% of the monetary allowance for each disabled member of the family of a deceased serviceman;
  • monthly compensation for damage to health - from 3,448.99 to 17,244.99 rubles per month, depending on the disability group;
  • monthly monetary compensation to family members of a deceased serviceman - the same amount is divided by the number of family members entitled to payment;
  • monetary compensation for damage to health (for military personnel affected by the Chernobyl accident) - from 3685.17 to 18425.94 rubles per month, depending on the disability group;
  • monetary compensation to family members of deceased military personnel - the same amounts that are divided among all family members entitled to payment.

Thus, military pensions actually depend on several figures - first of all, on the allowance and the reduction factor.

Long service pension amount

As such, there is no special formula for calculating a military pension. But based on Art. 43 Federal Law No. 4468-1, you can determine the methodology for calculating payments for military personnel who served in the armed forces for 20 years or more:

If the military service is more than 25 years, of which at least 12 years and 6 months are military service, then it should be multiplied not by 3%, but by 1%.

Law No. 4468-1 deals with the concept of “calculated pension”. Based on it, bonuses, the minimum pension amount, and various increases to it are established.

Estimated pension is equal to social

Therefore, the minimum military pension cannot be lower than 5034.25 rubles (the size of the social pension in 2020).

How much will the pension increase and when?

Federal Law No. 4468-1 defines the procedure for indexing cash payments to military retirees. Based on Article No. 49, pension payments should increase in proportion to the growth in income of active military personnel. But in 2012, federal law suspended indexation “until better times.” The moratorium was lifted only in December 2020. The last increase in pension payments was made at the beginning of 2020. According to official data, the rise in prices for consumer goods did not exceed 4%. Therefore, the increase in the amount of payments was also 4%. More than 38 billion rubles were spent on this from the state treasury.

When planning the 2020 budget, the government expected to allocate funds to increase pension benefits for retirees by only 4.3%. This is exactly the level of inflation predicted by Rosstat. It was also planned to extend the moratorium on increasing the reduction coefficient until the beginning of 2020. Let us recall that at the moment its value is 72.23%. In the same way, the state plans to increase the salary of the defenders of the homeland serving.

In October 2020, at the Kremlin ceremony for appointing positions to officers and prosecutors, he thanked the defenders for their military work and announced his decision. Government officials explain this by the impossibility of increasing pensions earlier than monetary allowances. Representatives of the State Defense Committee believe that in this way the government saves budget funds. The head of the Committee, General Shamanov, has repeatedly expressed dissatisfaction with the policies of the authorities. According to him, it would be more reasonable to carry out an increase from the beginning of the year, since indexation will not be able to compensate for what inflation has “eaten”.

What is a reduction factor

The increase in military allowances led to the fact that there was no longer enough money in the budget, and since 2012, pensions began to be calculated not at 100% of the military’s monetary allowance. On November 8, 2011, Federal Law No. 309 was issued, according to which Article 43 of Federal Law No. 4468-1 was supplemented with a second part. Its main theses are:

  1. From January 1, 2012, monetary allowance, which is taken into account when calculating pensions, is calculated at 54%. When calculating pensions, this parameter is usually called the “reduction factor”;
  2. From January 2013, the reduction factor increases by 2% annually until it reaches 100%. This is why the year of retirement is so important. For example, if a military man retired in 2013, then the coefficient will be 56%, in 2014 58%, and so on. But the increase could be more than 2% if the inflation rate in the coming year is high.

The reduction factor was expected to reach 100% in 2036. But the effect of part 2 of Art. 43 was suspended several times (in 2020, 2020, 2020, 2020, 2020), so it is difficult to name the exact date when the military will receive a full pension.

Why military pensions are growing

Unlike civil security (insurance, state and social), the calculation of pensions for army personnel has its own specifics. The size of payments directly depends on several factors:

  1. The amount of pay for military personnel. SDD is calculated in rubles and consists of salary according to military rank and salary according to military position.   3. Direct indexing. According to the Decree of the Government of the Russian Federation No. 238 (03/07/2018), the coefficient from January 1, 2019 is set at 1.04.
  4. Individual allowances. A retired military member's pension income increases by a certain percentage if the retiree, for example, is a veteran or has a disability.

Amount of military survivor's pension

A pension to a military serviceman’s family is granted in the following cases:

  • if he died due to injury, mutilation, illness received during service;
  • if he has already received a pension or died no later than 5 years after its payment ceased.

How will military pensions increase in 2021?

Since military pensions depend on the monetary support of military personnel, they will definitely increase from October 1, 2020 - but only by 3%.

This is exactly the inflation that Rosstat calculated last year. Promotion awaits not only military personnel, but also employees of other law enforcement agencies, as well as civil servants.

As for the reduction coefficient, there are no plans to raise it - at least until 2021 it will be 73.68%.

Accordingly, military pensions will increase by only 3% from October 1, 2020. For comparison, last year they grew by 6.3% - of this figure, 4.3% was an increase in monetary allowance, and 2% was an increase in the reduction factor. Some politicians even complained that in 2020, military pensions would increase by the lowest percentage in recent years.

Accordingly, in this case, military pensions will immediately increase by 6%. However, given the tension with the budget due to the crisis, there is no point in hoping for this.

For example, if a military man wants to receive an insurance pension in 2020, then the IPC should be 6.6 + 2.4 =9, if in 2020, then: 9+2.4=11.4, if in 2018, then: 11.4+2.4=13.8, if in 2020, then 13.8+2.4= 16.2;

This means that the amount of cash allowance taken into account when calculating pensions will remain at the level of October 1, 2020, when a very belated and insignificant increase took place. Increasing the insurance pension for military personnel

Indexation of pensions for military pensioners in 2020: what deputies decided

On October 1, 2020, military pensioners will increase pension payments by 6.3 percent. Their value directly depends on the increase in the pay of military personnel (abbreviated as DDV), and increases after it.

In October, DDV will increase by 4.3%. This is the inflation rate determined by the Government of the Russian Federation. This is the requirement of Federal Law No. 306-FZ of November 7, 2011 - on monetary allowances for military personnel (clause 9 and clause 16 of Article 2). Money for indexation is reserved in the federal budget approved for 2019-2021. Another 2% will be added to the pension based on Presidential Decree No. 604, issued on May 7, 2012. The document states that the annual indexation of military pensions should be ahead of inflation - by no less than 2 percent.

Despite the upcoming increase in pensions, Law No. 460-FZ of December 11, 2018 has caused discontent among military pensioners. It is due to the fact that the document extended the moratorium on clause 2 of Art. 43 of Law No. 4468-1 of February 12, 1993, according to which the amount of additional income taken into account when calculating the pension should increase annually by 2% until it reaches 100% of the monetary allowance. However, since 2020, there has been no growth, since a law was passed annually to suspend the validity of this clause.

In the original version of bill No. 556372-7, which then became law No. 460-FZ, it was proposed to completely suspend paragraph 2 of Article 43 of Law No. 4468-1 for another year. That is, despite the aforementioned Presidential Decree No. 604, the indexation of military pensions in 2020 would have been carried out at the level of 4.3 percent, and not 6.3.

The situation has improved thanks to the amendment introduced by the head of state. From the final text of Federal Law No. 460-FZ it follows that from January to September 2020, the amount of additional income taken into account when calculating a military pension remains the same - at the level of 72.23% of the full salary. However, from October 1, this value increases to 73.68%. By the way, it is this increase that will make it possible to further index military pensions by 2%.

However, many recipients of these pensions believe that the planned indexation of military pensions is completely insufficient and discriminatory. If only because, unlike ordinary pensioners, military personnel will receive a pension increase not at the beginning, but at the end of next year. In addition, it does not take into account periods when inflation rose for several years and military pensions were not indexed.

Will the second military pension be canceled?

At the end of 2020, information appeared in the media that military service pensions would be replaced with a “social package.” That is, instead of a military pension, military personnel will receive a lump sum payment. Its size will allow him to live comfortably for 1 or 2 years, during which he will have to find a job. All this is associated with the difficult economic situation in the country and the traditional lack of money.

Also, there are opinions that they will increase the length of service from a minimum of 20 to 25 years and cancel the military insurance pension.

None of these rumors have been confirmed

There have been no official comments on these issues, so all this news remains at the level of rumors.

The second pension will not be abolished in 2020, but the size of the IPC will gradually increase by 2.4 annually and the minimum insurance period will be increased to 15 years.

The peculiarity of calculating military pensions is that they should increase in several directions:

  • due to the growth of the reduction factor (RC);

After the increase, as of October 1, 2020, pensions through the Ministry of Defense will amount to an average of 26.2 thousand rubles, for former FSB employees - 30 thousand rubles, for employees of internal affairs bodies - 17 thousand rubles, reported in December 2020, in the Federation Council, Deputy Director of the Department of Budget Policy in the Sphere of State Military and Law Enforcement Service and State Defense Procurement of the Ministry of Finance Ilya Sevodnyasev.

The accelerated increase in military pensions this year “is primarily due to the state’s desire to provide military pensioners with a decent standard of living,” says Pavel Malyutin, lawyer at the Military Bar Association. “The size of a military pension differs from, let’s call it conventionally, a civilian pension and, one might say, significantly. The average military pension for an officer is 23–24 thousand rubles. Its size depends on the length of service, rank and the amount of salary of the serviceman, so it can vary both up and down. If you have a lot of service and a high rank, the pension can be very worthy,” the lawyer said.

For comparison, the average civil old-age pension is about 15 thousand rubles, in addition, the military and security forces were left out of the increase in the generally established retirement age.

“Although at a certain period the military profession lost its former attractiveness, I think that such social measures are aimed at restoring the prestige of the profession and are an attempt to attract citizens to military service,” Malyutin concluded.
