Why do you need a preferential certificate?

In 2020, after the reform, the retirement age limits are (Part 1 of Article 8 400-FZ):

  • 65 years old - for men;
  • 60 years - for women.

However, some categories of citizens have the right to apply for early retirement. Lists (No. 1 and No. 2) of professions and positions that allow for preferential pension provision are given in Resolution of the USSR Cabinet of Ministers No. 10 of 01/26/1991 (as amended on 10/02/1991). This list is used in accordance with Art. 30 400-FZ.

If a citizen was involved in production or employed in a position included in the lists and worked for the appropriate period of time (chose the appropriate length of service), then he has the right to issue a preferential certificate and an accompanying package of documents to the Pension Fund.

Retirement rules from 2020

By decision of the authorities, a pension reform has started in Russia, according to which the retirement age for men is increased to 65 years, and for women - to 60 years.
But this is by 2023. In 2020, women will be able to leave work at 56 years old, and men at 61 years old. More detailed retirement schedule by year

Some workers retained benefits and were allowed to retire early. But early retirement will be granted to a woman whose experience is 37 years or more, and a man with 42 years of experience.

Employees may also qualify for benefits if:

  • their professions involve difficult and harmful working conditions;
  • they worked in the Far North;
  • they worked in such fields as aviation, art and culture, health care and education, military and civil defense;
  • were injured or were born disabled.

Women who have raised 3 or more children, parents and guardians of people with disabilities since childhood, and pre-retirees who registered as unemployed at the labor exchange but were unable to find a job will also be able to retire early.

What other documents are needed for a preferential pension?

As part of the documentation for applying for a preferential pension, you must submit:

  • certificate;
  • passport of a citizen of the Russian Federation;
  • SNILS;
  • work book;
  • a certificate from the employer about the average salary for 5 years of work (the applicant can choose any five-year period);
  • a document confirming the right to early retirement (letter of confirmation from the employer, information that the citizen worked in difficult working conditions, etc.).

Characteristics of working conditions

There are four classes of hazardous conditions.

Important! For conditions of classes 3 and 4, it is mandatory to apply the requirements for safety measures for the use of PPE in accordance with current legislation.

Where to get a pension certificate

The form itself and all supporting documentation must be provided to the applicant directly at the place of his employment. Before the early retirement date, the employee turns to the employer with a request to fill out such an application with the Pension Fund. This issue is dealt with either by the human resources department or by an employee who is entrusted with the functions of working with the Pension Fund.

The employer must provide a completed and signed application no later than 3 days from the date of the employee’s application.

If the organization in which the applicant was employed and in which he had difficult working conditions or hazardous work was liquidated at the time of the application, the citizen will have to contact the archive where all documents were transferred after the liquidation of the institution.

What should be specified

The certificate is not a unified form, so the employer has the opportunity to draw up a document with the Pension Fund in free form by filling it out on company letterhead. The main condition for such documentation is a broad evidence base that the citizen has the right to early retirement leave, that is, the certificate must include as much information as possible confirming the possibility of the benefit.

Despite the fact that the register can be developed by the institution independently, the specialist must follow various methodological recommendations. For example, when calculating the preferential length of service that gives the right to early retirement, you need to take into account the rules established by the RF Regulation No. 516 of July 11, 2002.

The sample preferential certificate to the Pension Fund must include the following data:

  1. Full and short name of the employer, his details.
  2. Last name, first name and patronymic of the employee.
  3. An employee's position giving the right to a benefit in accordance with Art. 30 400-FZ and approved lists.
  4. The date of hiring and dismissal (if any), indicating the details of the orders.
  5. The periods during which the employee underwent advanced training were on student leave, child care leave or unpaid leave.

The register must contain its number and date, as well as the corner stamp of the institution. The document is signed by the head of the institution, the chief accountant and, if available, the head of the personnel department. The form is also certified with a “living” seal.

The documentation for the Pension Fund should not contain errors, corrections or false information. The territorial fund will refuse to accept an incorrectly compiled form, and the responsible specialist may be fined.

Certificate for medical and sanitary examination

The main task of the ITU is to determine a person’s disability.

This certificate is issued in the following situations:

  • diagnosed with an occupational disease;
  • injury at work;
  • loss of ability to work as a result of occupational injury.

The ITU commission requires a certificate about the working conditions of the employee where the injury occurred. The purpose of such a certificate is to identify hazards in the work environment.

List of required information in the certificate:

  • Full name and position of the employee;
  • Company name;
  • employee's passport details;
  • operating mode;
  • class of working conditions according to the classifier;
  • complexity of the work;
  • the presence or absence of psychological and physical stress;
  • the presence of harmful factors: noise level, dust, ultrasound, infrared radiation;
  • presence of occupational diseases of the employee;
  • signatures of the parties and seal.

Features of the help for ITU:

  • Only the manager, doctor or nurse at the enterprise, or trade union representative have the right to sign;
  • the presence of workplace automation is reflected;
  • information about the production rate is reflected;
  • factors that influence the level of vision are indicated;
  • describes the position in which the employee works;
  • the categories of harmfulness according to the classifier are described.

Features of the description of the employee’s working conditions in the certificate:

  • the presence of labor tension, which is caused by a high level of responsibility, the need to concentrate attention and an increased level of danger;
  • higher loads compared to usual ones;
  • characteristics of the workplace. An indication of the equipment, materials, technical devices used;
  • describes the need to lift heavy objects while performing duties;
  • is the use of special clothing required;
  • description of labor parameters that affect health status;
  • presence of dust;
  • presence of ultrasonic influence;
  • sending an employee on business trips.

If the company has a medical office, the certificate is drawn up in the presence of a medical professional.

How to confirm Soviet experience in court

This method may be required in cases where:

  1. There is no way to recover lost documents.
  2. The employer ignores the application requesting a certificate.
  3. The documents incorrectly indicate the position or place of work, which deprives the citizen of the right to a preferential pension.
  4. There is no data on pension contributions from wages in the database of the Pension Fund or the Social Insurance Fund.

During the trial, official requests may be sent to clarify information to archives at various levels, extra-budgetary funds, etc. If necessary, the court may call witnesses. Regardless of the form of clarification of work periods (with the help of documents or eyewitnesses), it will be possible to confirm in this way only the work intervals themselves for inclusion in the length of service; it will not be possible to prove the payment of pension contributions in this way.

In what cases may you need to obtain a salary certificate?

In order to obtain financial support in connection with reaching a certain age, a citizen must provide the Pension Fund of the Russian Federation with some official papers in accordance with the list established by the organization.

So, this list includes such documents as:

  • citizen's work book;
  • person's passport;
  • SNILS.

At the same time, it is the work book that must prove that you have work experience. It is used as a guide in cases where it is necessary to prove that a person had work experience before 2002. The fact is that after the specified calendar period, all information about workers and their work experience began to be contained in the database of the Pension Fund of our country.

Please note: the resolution of the Ministry of Labor (No. 16 of February 27, 2002), which stipulated the right of Pension Fund employees to provide this certificate, has long lost its force . Despite this fact, the department still continues to request it.

However, it is difficult to say exactly what it will bring you, even in the event of an unlikely victory, since ultimately it is in your interests to increase the amount of the pension payment determined by the Pension Fund.

Confirmation of experience with witness testimony

Witness testimony can be a good help for citizens who need to confirm their work experience if, for some reason, other documents are missing.   • A document that confirms with facts the circumstances as a result of which the work book was damaged or lost. For example, confirmation from the fire inspection service about a fire at the facility, indicating the date of the event.
  • Certificate of loss of the book signed by the employer indicating the reasons.
  • Certificate from the archive about the absence of data on the requested periods of work.

If the loss of documents occurred as a result of careless storage or intentional destruction, but the employee is not to blame for this, then the testimony of 1-2 witnesses can be used as confirmation of work experience. They must be the employee’s colleagues, that is, work at the same enterprise. According to their testimony, the duration of work should not be longer than that established by law when assigning a pension. It is permissible for a witness to provide his testimony in writing if he is unable to testify for objective reasons, for example, in case of illness. In a situation where the Pension Fund decides not to take into account length of service based on testimony, then citizens can resolve this issue through the court.
