Consequences of future reform

The bill receives different assessments: the government and the Pension Fund declare a lot of positive aspects of the planned reform, while the media promise a sad forecast for the economy and citizens.

The main question that worries many at the moment is whether the preferential pension will remain for educators? It follows from the proposed reforms that preferential accruals will not be abolished, but a situation may arise with a delay in their assignment. The rule according to which teachers will be able to switch to financial support from the state after working for 25 years remains without discussion.

It is important to know! According to the Prime Minister of the Russian Federation, in the course of the adoption of reforms, the minimum pension amount may increase by 1,000 rubles.

Regulatory documents for assigning a pension

The regulatory framework defining the right to early pension provision for long service in connection with work in educational institutions.

It is worth noting that at different times in your career there were different regulations defining working conditions and rules for calculating length of service giving the right to early retirement. These regulations differ from each other. For example, previous legislation made it possible to include a certain list of positions in comparison with the present one. Taking this into account, the current regulations allow you to include and calculate length of service, taking into account the norms and rules of the legislation that was in force during the period of your working activity. There are four such acts, namely:

  1. List of positions and institutions in which work is counted towards length of service, giving the right to early assignment of an old-age labor pension to persons who carried out teaching activities in institutions for children, in accordance with subparagraph 19 of paragraph 1 of Article 27 of the Federal Law “On Labor Pensions in the Russian Federation” ", approved by Decree of the Government of the Russian Federation of October 29, 2002 N 781 "On the lists of jobs, professions, positions, specialties and institutions, taking into account which an old-age labor pension is assigned early in accordance with Article 27 of the Federal Law "On Labor Pensions in the Russian Federation" Federation”, and on the approval of the rules for calculating periods of work giving the right to early assignment of an old-age labor pension in accordance with Article 27 of the Federal Law “On Labor Pensions in the Russian Federation”. The latest act adopted defines the range of positions and the list of relevant institutions. The validity of such a list begins on January 1, 2002. Such a list can be applied both to periods of work occurring after its introduction, and before.
  2. List of positions in which work is counted towards length of service giving the right to a pension for length of service in connection with teaching activities in schools and other institutions for children, approved by Decree of the Government of the Russian Federation of September 22, 1999 N 1067 “On approval of the List of positions, work in which it is counted towards the length of service giving the right to a pension for long service in connection with teaching activities in schools and other institutions for children, and the Rules for calculating the length of service for assigning a pension for long service in connection with teaching activities in schools and other institutions for children" . The so-called intermediate list based on its validity period, which was from November 1, 1999 to December 31, 2001 inclusive;
  3. List of professions and positions of public education workers whose teaching activities in schools and other institutions for children entitle them to a pension for long service according to the rules of Article 80 of the RSFSR Law “On State Pensions in the RSFSR”, approved by a resolution of the Council of Ministers of the RSFSR dated September 6, 1991. N 463 “On approval of the List of professions and positions of educational workers whose teaching activities in schools and other institutions for children give the right to a pension for long service.” The validity period of this list is from January 1, 1992 to October 31, 1999 inclusive;
  4. List of institutions, organizations and positions in which work gives the right to a pension for long service (Appendix to the Resolution of the Council of Ministers of the USSR of December 17, 1959 N 1397 “On long service pensions for workers in education, health care and agriculture”). This list is applicable to periods of work prior to 01/01/1992. One of the most loyal lists to teaching staff.

Calculation of preferential pension

To calculate the amount of pension benefit payments to employees of educational institutions, the data specified in the certificate of income received is taken into account. In this case, the final indicator will directly depend not only on funded, but also on insurance pension benefits.

In addition, the main condition for accruing a pension ahead of schedule is the accumulation of a strictly defined number of points. For 2020, this figure was 11.4, and in 2020 – 13.8. This increase will continue by 2.4 percent annually until 2025.

What categories of education workers are entitled to a preferential pension?

Teachers are given the right to a preferential labor pension. It is guaranteed, for example:

  • the director and deputy who work directly with students;
  • Head of Academic Affairs;
  • teachers;
  • teachers of preschool educational organizations;
  • school teachers;
  • teachers teaching additional education programs;
  • teachers working in a music school, in a physical education institution;
  • other specialists.

More detailed categories are listed in Government Decree No. 781 of 2002.

But to assign such a pension, only the position available in this list is not enough. The place of work of a teacher is important. It must be mentioned in a special list of educational institutions whose employees are entitled to this payment. So here's the list:

  • institutions implementing general education programs;
  • organization of preschool education;
  • primary or secondary vocational education;
  • specialized children's institutions.

How to apply for a pension?

In order to switch to financial support from the state, an employee of an educational institution must provide the relevant documents at least a month before the scheduled withdrawal date. You should visit the branch of the Pension Fund located at your place of residence, sending the appropriate application.

Required documents

When submitting an application to the Pension Fund of the Russian Federation for a preferential pension, music directors of the kindergarten, as well as other employees, must present the following documents:

  1. Passport or any other certificate confirming Russian citizenship.
  2. Work record book with a detailed indication of work experience.
  3. Certificate of income for the last working period.
  4. If you have children, their birth certificate.
  5. For men, you must present a military ID.

Employees of preschool institutions work under a busy work schedule, and their activities are extremely important and labor-intensive. That is why teachers’ pensions are calculated on special preferential terms.

As a certain age approaches, all teachers think about what kind of pension teachers have and under what conditions they can receive it. At the same time, you don’t have to give up your favorite job.

Special working conditions make it possible to obtain certain privileges provided for by government programs. Compared to other categories of working members of society, teaching staff have the right to earlier retirement.

Determination of a preferential pension for a kindergarten teacher

In recent years, numerous changes and additions have been made to the rules for receiving pensions for different categories of citizens, which quite logically raises questions about its calculation, terms, amounts and principles of receipt by different groups of teachers.

There are two types of pension provision:

  • Due to old age. Most working people receive this payment.
  • By length of service. It is calculated depending on which category the future pensioner belongs to.

At the moment, the name “long-service pension for kindergarten teachers” is not used and is considered obsolete. Now the teacher receives pension benefits if certain conditions are met. This option is called preferential or early retirement.

Who can receive a pension before the deadline?

Since significant additions and changes have been made to the regulatory documents, early pension for a kindergarten teacher from this year is regulated by the following regulatory documents:

  • Federal Law “On Insurance Pensions”, which came into force in 2020. It covers issues of pension provision with preferential terms of formation.
  • Government Decree No. 665 of this year determines the list of representatives of the teaching staff entitled to receive such benefits.
  • Government Decree No. 781 of 2002 regulates the procedure for calculating pension funds.

So far, there is no separate law on the provision of preferential pensions, but further changes and adjustments are planned in the future. In particular, in the future the retirement age may be increased, but at the moment the teacher’s retirement date remains unchanged.

In order to take paid leave, you must work for at least 25 years, taking into account all legal requirements. However, not all representatives of the teaching profession will be able to receive payments. With regard to early pensions for employees of preschool institutions, the following categories of employees can count on its accrual:

  • Teachers of different categories.
  • Senior teacher.
  • Methodist (as a separate specialty in a preschool educational institution).
  • Teacher-educator.

It is necessary to take into account that the junior teacher (assistant, nanny) belongs to the support staff and cannot count on early retirement. This category of employees now receives a pension on a general basis, that is, upon reaching a certain age.

Formation of length of service, retirement age, other conditions for retirement

It does not matter what time teachers retire, since to determine the level of payments, it is not the age of the applicant that is taken into account, as when calculating old-age maintenance, but the length of service the teacher has worked.

The minimum experience of a teacher for retirement is at least 25 years. At the same time, he needs to work out this time under specific conditions:

  • Work in preschool institutions where the profession of a teacher is used.
  • The position of a potential pensioner correctly recorded in the work book. This is a necessary condition for calculating benefits for preferential pensions.
  • Required level of IPC (individual pension capital). Until 2020, it was equal to 9 points; since this year, its level has risen to 11.4 points. By 2025, the IPC should rise to 35 points.
  • Performing duties during a full working day for which insurance premiums were paid, including periods on sick leave. For different categories of educators and kindergarten teachers, different time periods are established:
  1. 30 hours per week for employees of children's educational institutions.
  2. 25 hours for educators and teachers working with children with disabilities.
  3. 20 hours for speech therapists and defectologists working in preschool educational institutions or schools.

On individual terms, pensions for kindergarten teachers are calculated for the following categories of workers:

  • Heads of boarding schools and orphanages.
  • Primary school teachers working in rural areas.
  • Teachers of musical culture.

When calculating the pension, the following points will not be included in the length of service:

  • Vacation during the working period.
  • Unpaid types of leave.
  • Missing work for an unexcused reason.
  • Temporary part-time work or transfer to another workplace.
  • Time to care for a disabled person or a newborn, with the exception of parental leave for a child under three years of age, which took place before October 6, 1992.

If the activity of a teaching employee began before September 1, 2000, then the previous length of service will be fully included in the period for calculating a preferential early pension.

Registration of pension

Teachers' pensions are calculated based on their applications. At the same time, if a preschool educational institution employee does not express a desire to leave his position and wants to continue working in a kindergarten, his preferential opportunities remain with him in full.

When a teacher retires, he collects all the necessary documents in advance and applies to the regional office of the Pension Fund of the Russian Federation or at his place of registration. Since, due to changes in legislation, many questions arise regarding the accrual of preferential length of service, you need to start checking documents long before the appropriate moment arrives. Especially many surprises await applicants due to incorrect or inaccurate filling in the job title in the work book. All this can affect the calculation of the grace period and lead to litigation.

To submit an application, you must prepare the following documents:

  • Passport of a citizen of the Russian Federation.
  • Employment history.
  • For male teachers - military ID.
  • SNILS.
  • Certificate of registration of the birth of a child or children (if any).
  • Marriage certificate (for women who changed their last name upon marriage).
  • Certificate of income received for the last 12 months.
  • A clarifying certificate necessary to confirm the conditions and nature of the position performed.
  • Application for early pension payments.

You can submit documentation either in person or using the services of an intermediary, in paper or electronic form. It takes up to 10 days to review submitted applications.

The issue of canceling or changing the preferential pension has been raised more than once, but at the moment no action has been taken in this direction. But for those categories of educators who may qualify for early retirement, everything may change in the future, so increased attention is required to the government's adoption of relevant decisions and legislation.

Since this year, wage growth has influenced the increase in pensions. Also in February of this year, pension payments will be indexed, taking into account the 2020 inflation rate. How much pensions will be increased will become clear in January of this year.

If the Pension Fund of the Russian Federation denies an applicant an early pension, the teacher has the right to file a claim in court. It is drawn up according to a sample and requires strict compliance with all registration standards, otherwise the document will be returned to the applicant for corrections.

Early retirement does not mean that working as a retired teacher has to stop. He can continue to work at the preschool educational institution or go on vacation at his own request.

Long service pension for teachers

  • fulfillment of the established workload is not required (clause 6 of the Rules): for primary school teachers;
  • for rural teachers;
  • the rate must be fulfilled regardless of the time when the labor activity was carried out (clause 5 of the Rules):
      for music directors;
  • for teachers working in special institutions for children listed in paragraphs 1.11, 1.13 of the List.
    • the presence of a certain number of individual coefficients (in 2020 they need to be 16.2; then the requirement for them will increase annually until it reaches 30 in 2025);
    • Employment in teaching activities for at least 25 years in institutions for children.

    Pension for length of service for head of dow in 2020

    The length of service will include periods defined by law. Moreover, the concept of “special insurance length of service” now applies - this means that not only the time of direct work activity will be taken into account, but also other periods, including vacations, sick leave, etc.

Parental leave occurred during the period from 10/05/1989 to 04/05/1991. By law, this period is included provided that the vacation took place before October 1992.
