Contract service in the north: conditions, compensation, pros and cons


In recent years, service in the Russian army has become increasingly popular and attractive. For young citizens, army service has become much more interesting due to the appearance of new types of weapons in the troops and their intellectual content, as well as the level of monetary remuneration and social guarantees provided to military personnel. However, some military personnel, for various reasons, leave service without serving the prescribed period, and then take a job in the civilian sector of the economy. Such citizens have questions related to how the period of military service will be counted towards their length of service, and how the army service that took place in the northern regions of our country is taken into account. The same questions concern citizens who have served in military service.

Military personnel, as well as equivalent employees of law enforcement agencies and other law enforcement agencies, in the event of dismissal from service, have the opportunity to transfer from the state pension system to the general civilian system of compulsory pension insurance. At the same time, the procedure for determining their insurance experience is regulated by the “Rules for calculating and confirming insurance experience for establishing a labor pension”, approved by Decree of the Government of the Russian Federation of July 24, 2002 N 555. By these rules, the payment of insurance contributions for state social insurance is equated to the payment of contributions to compulsory pension insurance of citizens. Documents confirming the period of military service (or other service) are a military ID, a certificate from a military unit, a certificate from the military registration and enlistment office, as well as an entry in the work book made on the basis of documents containing information about the period of military service.

Now it is necessary to note the fact that the current pension legislation has clearly established that the period of military service (as well as service in various state law enforcement agencies) is counted in a citizen’s insurance period along with the periods of his work in civilian enterprises (clause 1 of paragraph 1 of Art. 12 of the Law on Insurance Pensions No. 400-FZ).

It would seem that if, in accordance with the law, military service is equated to labor activity, then the period of military service in the northern regions should be included in the special length of service of a former military man on an equal basis with his civilian labor activity, which gives the right to early assignment of an old-age labor pension, as it occurs in civilians.
However, the pension legislation does not directly indicate the inclusion of the period of military service in the North in the preferential length of service, and this introduces an obstacle to including the period of military service in the North in the preferential length of service, for the early assignment of an old-age insurance pension.
In this regard, the ruling of the Constitutional Court of the Russian Federation dated March 10, 2005 No. 14-O established that when determining the procedure for preserving the pension rights of citizens in the event of their dismissal from military service, before they acquired the right to a state pension for long service, the legislator did not provide for the possibility inclusion of periods of service spent in the regions of the Far North and localities equivalent to them in the preferential insurance period, which gives the right to early access to an old-age insurance pension. And the Supreme Court of the Russian Federation, in its ruling dated August 26, 2005 No. 34-B05-1, pointed out the illegality of including the period of military service in the Far North in the length of service that gives the right to early assignment of an old-age insurance pension. The government, by its resolution of June 26, 1999 No. 692 “On the procedure for counting the period of military service in areas with unfavorable ...”, established that starting from 01.01.1998, the period of military service in the northern regions of our country and in other areas with unfavorable climatic (or environmental) conditions, where a regional coefficient and a percentage increase in salary are established, is counted towards persons discharged from military service (by age, for health reasons, due to staff reduction, due to the end of military service) in their labor length of service in calendar terms, only for them to receive a percentage increase in wages in case of employment in the same regions and localities. Calculation of the total length of service in order to receive a salary increase is made on the basis of a certificate issued by the military unit at the last place of service, which must indicate the basis for the citizen’s dismissal from military service and the period of service in areas with unfavorable climatic and environmental conditions.

Paragraph 5 of Article 10 of the Federal Law “On the Status of Military Personnel” No. 76-FZ establishes: military personnel undergoing military service in the regions of the Far North, equivalent areas, and other areas with unfavorable climatic or environmental conditions, including remote ones, or beyond outside the territory of the Russian Federation, as well as in military positions associated with an increased danger to life and health, federal laws establish additional social guarantees and compensation. Thus, the legislator seems to be saying that the hardships of service in difficult climatic conditions should be compensated while the serviceman is in these conditions, and not after.

Features of service in the north

Contract service

When entering military service on a contract basis, a serviceman is offered a standard salary without specifying any preferential conditions, but the contract specifies the place where the contract soldier is going to serve.

If the place of service coincides with the concept of “northern region”, then the corresponding benefits are automatically assigned, which relate to two main areas:

  1. Assignment of additional wages taking into account the so-called northern coefficient.
  2. Providing benefits for early retirement.

In addition to the introduced coefficients, each region of the country with harsh service conditions is assigned to one of four difficulty categories. For example, Chukotka belongs to the first category of complexity. This division makes it possible to introduce additional preferential allowances, which are defined as 10% of the soldier’s initial rate and are added for every six months of his contract service in the north.

As a result, if a contract soldier serves for 5 years in an area of ​​the first category of complexity, then his salary only under this benefit will increase by 2 times. In the case of the fourth category of complexity, this premium will be 30%.

In addition to increased salaries, contract military service in the Far North offers other benefits. The main ones are the following:

  • The state provides housing to the contract soldier within three months after the start of his service;
  • there are lists of things and products that are also given to military personnel free of charge;
  • the opportunity to travel once a year for free from any part of Russia to another point and back, regardless of what type of transport (train, plane, etc.).

Conditions of retirement

The advantages that attract many to service in the north sometimes do not correspond to reality. This is evidenced by many reviews of the guys who served there. It is very difficult to work, much less serve, in the Far North, where summer lasts only one month. And the rest of the time there are frosts of -30, blizzards and polar night.

Service on the territory of units located in territories that are equivalent to the northern ones, for example on Sakhalin or Western Siberia, according to reviews, is more favorable. Because the climate here is milder than, for example, on Novaya Zemlya. But still, in any case, reviews of contract service in the north convince us that it is not so simple.

Every contract soldier, before accepting any vacancy for contract service in the north, must first carefully consider all the disadvantages and risks, and not just take into account the promised advantages.
