The painter has the right to a preferential pension

  1. Full time job. There are established standard hours for teachers of different classes. The total number of hours worked per year must be at least 240, and for middle school teachers this figure is 360 standard hours. The period for retirement according to lists 1 and 2 is legally established, and this does not mean that a person is obliged to work in a hazardous enterprise all his life. For men, harm is earned by 10 years of service for list 1 and 12.5 years for list 2. For women, a shorter period is established - 7.5 and 10 years, respectively. For a pension on preferential terms, the total length of service is important, which is 20 years for men and 15 years for women. That is, representatives of the “stronger sex” on List 1 can retire at 50 years old, and women at 45 years old. Important! If a citizen applies to the Pension Fund after the retirement date, then payments will begin after a positive decision is made. Money is not returned for the missed period, so you should take care of your pension in advance.

Legislative regulation of all issues related to harmful working conditions obliges all workers to undergo regular medical examinations in accordance with the articles of the Labor Code and Order of the Ministry of Health No. 302 of April 12, 2011, which takes into account and identifies harmful production factors by profession.

After all, pension contributions under additional tariffs are calculated on the same payments as contributions under the basic tariffs. The legislation does not provide for any exceptions to the list of payments from which contributions at additional tariffs are paid. Pension according to lists 1 and 2 with incomplete service due to harmfulness

For employees of hazardous industries, there are no plans to change the length of service and age. There will be no changes in monthly contributions to the Pension Fund for the formation of future payments. As before, a reduction in the retirement age for an incomplete period of work in production is possible if the following requirements are met:

  • not less than 50% of the length of service established in the table;
  • availability of a sufficient amount of general experience and IPK.

The first list includes the most dangerous professions. Therefore, the discount is assumed for each year of work (one year, respectively). In the second list, professions are less dangerous, so for men one year is calculated for every 2.5 years, for women - for every 2.

List 1 requires the following conditions to be met:

  1. Age: 45 (F) and 50 (M).
  2. Specialized experience: 7.5 and 10 years (F and M, respectively).
  3. General: 15 and 20 years.

This list determines the age and requirements for early retirement with full service.

Additional contributions to the Pension Fund for hazardous working conditions

Modern legislation and new laws regarding pension benefits require employers to make additional contributions to the Pension Fund of the Russian Federation to a savings account. This approach will significantly increase the size of future labor supply.

Contribution rates

By virtue of Part 6 of Art. 30 of Law No. 400-FZ, periods of work in a profession from the relevant list that occurred after 01/01/2013 are counted towards length of service in the relevant types of work, giving the right to early assignment of an old-age insurance pension, subject to the accrual and payment by the policyholder of additional insurance contributions for the relevant tariffs.

Until January 1, 2017, such tariffs were established by Art. 58.3 of Law No. 212-FZ [1], after this date they are determined by Art. 428 Tax Code of the Russian Federation . In both cases, the need to pay and the amount of additional insurance premiums depended and depend on the results of a special assessment of working conditions carried out by the enterprise in accordance with Federal Law No. 426-FZ .

Early retirement plasterer-painter

For the period of work until January 1, 1992. in case of early assignment of an old-age labor pension to a painter, taking into account the resolution of the Government of the Russian Federation of April 24, 2003. No. 239, List No. 2, approved by the resolution of the Council of Ministers of the USSR dated August 22, 1956, can be used. No. 1173, according to which (Section XV, Subsection 6) painters acquire the right to early retirement coverage subject to their constant full-time employment with enamel paints, nitro paints, nitro varnishes and lead paints in metalworking industries.

  • Articles 210-211 of the Labor Code of the Russian Federation dated December 30, 2001 No. 197-FZ.
  • Decree of the Government of the Russian Federation (hereinafter - RF PP) dated March 29, 2002 No. 188.
  • GD of the Russian Federation dated July 16, 2014 No. 665.
  • Federal Law of December 28, 2013 No. 426-FZ “On special assessment of working conditions.”

Are construction foremen and foremen entitled to a preferential pension?

There is a special list that indicates the positions of those construction workers who are entitled to benefits ahead of schedule.

The special list includes ordinary workers, as well as people engaged in professional activities in the following areas:

To count the experience, the personnel officer must indicate the installation or construction field of activity in the work book. If the worker indicated that he worked simply as a foreman, then representatives of the fund must issue a certificate, relying on the collected package of documents.
