But in some cases, an employer must issue a SNILS for its employee: when hiring a person who has not yet officially worked anywhere; if the employee has lost the insurance certificate or it has become unusable; when changing the employee’s personal data (for example, changing the last name).

The procedure for obtaining a SNILS insurance certificate

First of all, the employee must contact the employer with an application to issue him a SNILS.

The application is written in any form, but with the obligatory indication of the following information of the employee, which is then entered into the appropriate form: Full name; Date and place of birth; floor; citizenship; permanent residence address; passport details.

Then the employer fills out a form for the insured person, which must be signed by the employee himself. The form of the questionnaire will depend on the occasion for which the employee made such an application: if the employee receives SNILS for the first time, then it should be form ADV-1; when exchanging SNILS due to a change in personal data, form ADV-2 is filled out; If you lose a document and request a duplicate, use form ADV-3.

A package of documents for issuing or changing SNILS is submitted to your territorial branch of the Pension Fund. At the same time, when you first receive SNILS (that is, in the ADV-1 form), the deadline for submitting documents is two weeks from the date of conclusion of the contract with the employee. The Pension Fund of Russia must transfer the insurance certificate to the policyholder along with the accompanying statement within three weeks. The employer is obliged to issue SNILS within a week after receiving it.

The employee must check the correctness of the information and sign the accompanying statement of receipt of SNILS. The signed statement must be returned to the Pension Fund within a month, which within three weeks makes a note about the issuance of an insurance certificate to the employee.

Responsibility of the employer for violation of the established procedure for issuing SNILS

As such, there is no liability for violation of this particular order. But in case of unresolved issues related to the issuance of an insurance certificate, problems may arise when submitting reports and paying insurance premiums for employees. In addition, the employer’s obligation to issue SNILS to employees upon first employment is specified in the Labor Code of the Russian Federation.
