Parents have the right to allocate funds from the MK for the education of one child or all children at the same time, at their request. At the same time, the following conditions for using the certificate in 2020 should be taken into account:

Use of funds in educational institutions

Maternity capital can be used to pay for the education of one of the children, or part of the education of several children, only after three years have passed from the birth or adoption of the child.
An exception is the allocation of MSC funds for preschool education, including the services of kindergartens and private nannies. Here age restrictions have been abolished since 2020. The legislation does not prohibit using this amount, in parts, and for each of the children, and not for one. It is possible to pay for college studies using maternity capital , since the law does not establish restrictions that would prohibit this. Maternity capital can also be used to pay for tuition in other institutions of secondary vocational education (technical school, college).

Studying at college is different in that a student can choose one of two areas of secondary education:

  • basic - 3 years ;
  • in-depth - 4 years .

Both of these areas can be paid for using a certificate, provided that the college is located on the territory of the Russian Federation and also has a license to provide educational services . Whether the chosen college is affiliated with the university or not does not matter.

How to pay for university studies with maternity capital?

In order for the certificate holder to be able to use maternity capital to pay for the education of an older child at a university or institute, it is first necessary to conclude a tripartite agreement with the university, in which the certificate holder will be declared as the customer, and the child as the student. Is it possible to pay for distance learning with maternity capital?

Law No. 256-FZ does not establish restrictions on the forms of education that can be paid for with maternity capital, which means the certificate funds can be used to pay for part-time . To do this, you need to conclude an agreement with an educational organization, in which, in addition to the cost, you must indicate the distance learning option. After this, the agreement with the application is submitted to the Pension Fund.

Maternity capital funds can be used to pay for not only part-time, but also part-time (evening) forms of education, if the chosen program requires it.

Supervision and care of children in a preschool educational organization

It became possible to transfer maternity capital not only for education, but also for paying for the maintenance, supervision and care of children in kindergarten not so long ago with the entry into force of Government Decree No. 931 of November 14, 2011 on amending the existing Rules. One of the conditions for directing maternity capital to paid educational services is the receipt of state accreditation by educational organizations for those programs for which it is planned to transfer certificate funds.

When choosing an institution where their children will study, parents should pay special attention to this fact, since the presence of accreditation of the organization itself does not guarantee the presence of such for all programs it implements . According to Art. 92 Federal Law No. 273 of December 29, 2012 “On Education in the Russian Federation”, the decision on state accreditation is made:

  • for basic general education programs of primary, basic, secondary education - in relation to each level separately;
  • for basic professional educational programs of higher and secondary education - for each group of professions, specialties and areas.

Since it is believed that education in Russia is free, in general, paid services in education include:

To pay for paid services related to education with maternity capital, the owner of the certificate enters into a written agreement on the provision of such services with the educational organization and submits it to the territorial body of the Pension Fund of the Russian Federation.

Since payments under the contract in most cases are provided for a certain period with a specified frequency, parents need to remember:

  • when changing the amount or terms of payment, as well as in case of refusal to send certificate funds for paid services, it is necessary to write appropriate statements to the Pension Fund of the Russian Federation;
  • amounts exceeding the actual costs of education are subject to return to the Pension Fund.

Accommodation of a child in a dormitory for the period of study at a university

In addition to direct education, according to the law, maternity capital can also pay for a child’s accommodation in a dormitory for the period of study at a college or university. To do this, the certificate holder enters into a rental agreement for residential premises with the university that provides the dormitory.

  • Transfer of MSC funds is carried out by bank transfer to the account of the higher educational institution specified in the rental agreement.
  • The first payment will be received within two months from the date of submission of the application for disposal of funds or part of the maternity capital funds, the rest - according to the deadlines specified in the agreement.

The grounds for stopping the transfer of maternity capital funds during the period of study at a university may be:

  • academic leave for medical reasons or at the student’s personal request;
  • expulsion from the university at will or due to poor academic performance;
  • death of a child.

In each of the above cases, the owner of the certificate must write a statement of refusal to send maternity capital funds, indicating the reason. Upon completion of the academic leave, it is necessary to re-submit an application to the Pension Fund for the disposal of MSK funds, attaching to it a copy of the order on the student’s admission to study .

Paying for a child’s education with maternity capital: practice and reviews

Despite the simplicity of paying for a child’s education using maternity capital, many parents encounter difficulties. They are:

  • Impossibility of paying for the services of an educational institution until the child reaches the age of three.
  • Lack of consent from educational institutions to accept payment from MK funds.
  • Problems with the educational institution having a license.

There may be a significant age difference between children, which is an obstacle to paying for the education of an older child at a university.

Example . The Sidorenko family has two children. The eldest daughter studies at the Institute of Economics full-time on a paid basis. The youngest son was only one year old. The children's mother is on maternity leave, the family lives off child benefits and the father's salary. They could pay for the education of their eldest daughter with MK, but they cannot, because... my son is less than 3 years old.

Revising the rules for processing payments would help completely solve the above problem. Another common situation is the refusal of an educational institution to accept payment from MK funds.

Example . Fedorova S.M. is raising two minor children. The youngest child attends kindergarten. The woman approached the director with a question about paying for the services of a preschool institution from MK, but was refused. As it turned out, the kindergarten accountant does not know how payment is calculated in this case and how exactly to conclude an agreement.

If management refuses to accept payment from MK funds, it is quite difficult to influence their decision. Compulsory conclusion of a contract is excluded.

List of educational programs subject to state accreditation

General education. It includes:

  • average;
  • basic;
  • initial.
  • Training for mid-level professionals (colleges and technical schools provide secondary specialized education).
  • Providing higher education. A citizen graduates from an institute, academy, or university.
  • Advanced training (subsequent retraining).

Funds from maternity capital can be used if the educational institution has programs that are subject to state accreditation. Only preschool institutions become exceptions here. The opportunity to pay for the education of a child (children) using maternity capital funds is in great demand today. Statistics show that the use of microfinance for education is in second place after family expenses for improving living conditions.

What documents will you need to submit to process tuition payments?

Parents of a student need to have:

  1. a certificate confirming the right to use maternal capital;
  2. proof of identity (passport);
  3. SNILS of the certificate owner;
  4. a statement indicating the purpose for which maternity capital is used;
  5. agreement on the child receiving education on a paid basis;
  6. a certified photocopy of the state certificate. accreditation of an educational institution;
  7. agreement for renting a square in a dormitory (you will need to attach a certificate certifying the fact that the young person is living in the dormitory; the document is approved by the educational institution).

We must remember! An application to the Pension Fund must be submitted before May 1 (meaning the year of admission to the educational institution).

If you use maternity capital, you will only need to submit basic documents by May 1st. The remaining papers that will be issued after receipt can be submitted to the Pension Fund before October 1 of the same year. And then the funds will be sent to the institution’s account from the Pension Fund.

Can the mother of a child use maternity capital for her own needs?

Back in 2011, deputies of the Russian Federation began to discuss the question of whether the mother of a child could use maternity capital in order to obtain her education. After all, this is a real benefit for the whole family, including its young members. Then the proposal to legalize this possibility was rejected. Although capital is called maternal capital, in 2020 it is allowed to use funds only for direct benefit for one’s children. The only option provided is how to use the money in the interests of the mother, and not the child himself. This is a transfer of funds to a pension savings fund.

Order rules

All possible directions for disposing of maternal capital are grouped in Federal Law No. 256-FZ. From the very beginning of the implementation of this program, the family could compensate for paid educational services in relation to their own children. Payment terms in this area have not changed significantly in 2020:

  1. Any educational services provided to a child before he or she reaches the age of 25 are subject to compensation (it is assumed that by this time the child will have completed his studies at a university);
  2. money from the budget is not given to parents or the child in cash, but is transferred to the account of the educational institution on the basis of an agreement;
  3. The educational institution must have a permit to provide such services - a license (it is attached to the training contract).

Please note that payment in this case will be made only within the limits of the remaining capital. If the family has not previously managed MSK funds, the entire amount will be available - in 2020 it is 466,617 rubles .

A new rule included in Resolution No. 926 is compensation for expenses for living in a hostel, including the payment of utilities. This option for spending maternity capital is an independent direction, i.e. it can be used simultaneously with payment for the educational process. We will describe below the procedure for confirming the costs of training and accommodation in a hostel.

In addition to compensating for the costs of studying at a university or technical school, parents can use other purposes for managing maternity capital:

  • additional educational services - sections, clubs, music and art schools, etc.;
  • preschool education and child upbringing;
  • payment for child care and upbringing services outside preschool institutions.

For each of these areas, the general requirements of Federal Law No. 256-FZ must be met - the institution must have a valid license, and the educational program must comply with state accreditation. These conditions make it possible to guarantee the quality of the educational process, since it will be monitored by authorized government departments.

In 2020, age restrictions on preschool education were removed from legislative acts - you can submit an application to the Pension Fund department immediately after the birth of a child giving the right to maternity capital. In this case, you need to take into account the time frame for checking documents in the pension department - 1 month for consideration of the application and up to 10 days for transfer of funds. Therefore, the actual disposition will take place only 1 month and 10 days after the application is submitted.

The spending options listed above can be used simultaneously for the benefit of several children, however, within the limits of the maternity capital balance. For example, you can pay for an older child’s education at a vocational school and, at the same time, compensate for the costs of kindergarten for younger children. Therefore, parents can apply for the transfer of funds to MSC repeatedly until they fully use the amount of maternity capital.

In what situations is the application canceled and the transferred money returned?

The certificate holder may wish to withdraw the application to use the funds for educational purposes. That is, the application is cancelled. For this purpose, the application is sent to the territorial branch of the Pension Fund. The applicant is:

  • the owner of the capital personally;
  • his representative.

The application can be submitted within 2 months (no later than this period) from the date of filing the previous application regarding the disposal of maternity capital. The moment of transfer of funds to the Pension Fund according to the previous application of the copyright holder should not yet occur.

How to register correctly

An agreement with an educational institution will be of key importance when allocating funds to MSK. When compiling it, the following rules must be taken into account:

  1. the text of the contract must indicate not only information about the child undergoing training, but also about the holder of the MSK certificate;
  2. the annexes to the contract must include a copy of the license, as well as a copy of the certificate of state accreditation of the educational program;
  3. Payment for the educational program can be made through a one-time payment or by establishing monthly payments.

According to the rules of the educational process in universities, the basis for admission to the next semester or course is the successful passing of exams. Therefore, the training contract will be renewed annually or every six months. Since the disposal of maternal capital occurs strictly according to the terms of the contract, each time parents have to re-collect documents and submit them to the Pension Fund department.

If payment is made for the hostel and utilities, the fact of residence will be confirmed by the rental agreement. This document is also subject to annual renewal. Expulsion from a university or granting academic leave automatically deprives you of the right to reimbursement of expenses from maternity capital - both for studying and for living in a dormitory.

When sending MSC funds for the services of preschool institutions, the following rules are taken into account:

  1. Only actual expenses are subject to payment - for this, the child’s attendance schedule will be taken into account, and if necessary, payments will be recalculated;
  2. if children or parents have state and municipal benefits for maintaining a child in kindergarten, maternity capital funds will be allocated only for the actual amount of payment;
  3. Payment from the budget is made only if the kindergarten has a license and a certificate of state accreditation.

The agreement with the preschool institution will also provide for a one-time payment or monthly payments. Money will be transferred to the DDU account in strict accordance with the payment schedule under the agreement. If the child did not attend kindergarten, the basis for recalculation will be the attendance schedule - the preschool institution will be required to return the remaining funds to the Pension Fund account (they will be taken into account in the remaining capital).

The contract with the preschool institution must specify the obligations for the care and education of a young child. In this case, the form of the kindergarten does not matter if it has a license - kindergartens can be of state or municipal subordination, or belong to a departmental fund.

Submission of documents

The basis for transferring funds in favor of the educational institution will be the application of the owner of the MSK certificate. It is submitted to the local Pension Fund department or through the MFC system. The complete list of documents that the applicant must submit is as follows:

  1. application for disposal - it can be submitted by the certificate holder himself or by a representative by proxy;
  2. the applicant’s passport or power of attorney for a representative;
  3. passport or birth certificate of the child;
  4. an agreement with an educational or training institution, accompanied by a license and certificate of accreditation;
  5. payment details by which funds from the budget will be transferred;
  6. certificate of enrollment of the child in the educational program;
  7. agreement for the rental of residential premises and the provision of utilities;
  8. MSK certificate.

When checking documents, the Pension Fund department is obliged to make a request to the educational institution to confirm that the child is studying. As a rule, such a request is sent through interdepartmental exchange channels and takes a matter of days. The total verification period cannot exceed one month, after which the money is transferred within 10 days.

Make way for mothers - a site for young parents

It is not very clear why this money cannot be spent on other purposes; apparently our deputies have their minds occupied with other things. A car would be very useful for many (and especially large) families to take their children out of town to visit their grandparents. But so far there is no such possibility. Such conversations had already taken place, but the prospects were not so rosy - maternity capital for a car was supposed to be allowed to be spent only when purchasing domestic opuses of the auto industry, which would not have the best impact on the safety of those same children, in fact. At this point the conversations reached a dead end and have not yet been returned to this. Perhaps this is for the best.
