In the event of the death of a pensioner, his relatives can receive his pension benefits, but only if the citizen died before receiving money for the current month. In this case, family members can only receive the deceased’s pension:

    • insurance;
    • cumulative;
    • military

In this case, the main condition is cohabitation with the pensioner on the day of his death. This must be confirmed by official documents. At the same time, in accordance with the legislation of the Russian Federation, special cases are provided when the fact of cohabitation does not matter.

Also, in addition to the unpaid security, relatives can apply for other payments, including a funeral benefit in the amount of 5,701 rubles 31 kopecks . In this case, it is necessary to submit an additional package of documents to the relevant authority within a certain time.

    The legislative framework

The issue is regulated by the following legal acts:

    1. Civil Code of the Russian Federation.
    2. Family Code of the Russian Federation.
    3. Federal Law No. 400 dated December 28, 2013.
    4. Federal Law No. 4468-1 dated February 12, 1993.
    5. Federal Law No. 360 dated November 30, 2011.
    6. Decree of the Government of the Russian Federation No. 711 of July 30, 2014.
    7. Federal Law No. 424 dated December 28, 2013.

Where does the deceased's pension go?

The unpaid pension of the deceased can be received by his relatives. In case of their absence, the funds remain in the Pension Fund accounts.

The law allows you to receive the deceased’s pension:

    • children,
    • spouses,
    • grandchildren,
    • grandparents.

To receive the payment, it is necessary that the relative live with the deceased in the same house or apartment.

This requirement does not apply to persons who were dependent on the deceased:

    • children under 18 years of age,
    • retired citizens,
    • people with disabilities.

The sum of money is divided among the heirs belonging to the same line in equal shares.

    Amount to be paid

In order to find out the amount that will be paid, you need to contact the Pension Fund or the Non-State Pension Fund with which the deceased pensioner signed an agreement. It is also possible to obtain information through the State Services portal, in Sberbank or by calling the SNILS number.

This video provides information on the payment of pension savings to the legal successors of deceased insured persons.

    For what period

Payment is made for 1 month, provided that the deceased did not have time to cash out the funds. According to Russian law, the accrual of subsidies stops on the 1st day of the month following the month in which the citizen died or was declared dead.

    Who can apply

Close relatives have the right to apply:

    • spouse, whose marriage was officially registered,
    • children (natural and adopted),
    • parents (adoptive parents),
    • brothers and sisters, grandchildren, grandparents,
    • disabled family members.

If the application comes from several persons and there is confirmation of their rights, then the shortfall in pension benefits will be divided equally between relatives.

    How is registration carried out?

The procedure for receiving a pension after the death of a pensioner is strictly regulated by Russian legislation.

    Where to contact

Depending on the payments due to the pensioner, the application is submitted to:

    • Pension Fund (insurance part),
    • Pension Fund or Non-State Pension Fund (savings part),
    • security department (military subsidy).

Is a pension due after the death of a pensioner?

    Algorithm of actions

Main steps on how to apply for a subsidy:

    1. Find out how many potential heirs there are.
    2. Agree on the distribution of money.
    3. Determine the territorial body of the Pension Fund to which the appeal should be sent.
    4. Collect the required documentation.
    5. Make a statement.
    6. Make sure the application deadline has not passed.
    7. Provide an account opened with a bank for the purpose of receiving the transfer.
    8. Wait for funds to be credited.

    Application deadlines

The application must be submitted within 6 months from the date the pensioner died. Otherwise, the application period will have to be restored in the courtroom.

    What documents to collect

    You need to prepare:

    • statement,
    • passport,
    • a certificate confirming that the pensioner has died,
    • a document proving the existence of a family relationship,
    • a certificate confirming that the applicant lived with the deceased,
    • bank account (if necessary),
    • a book reflecting the work history of the deceased,
    • military ID (if relevant),
    • power of attorney (if a representative is involved),
    • court decision (if any).

    What happens to surcharges

We are talking about such additional payments to pensions established at the regional level as:

    1. FSD (Federal social payment). Intended for pensioners with income below the subsistence level.
    2. EDV (Lump sum cash payment). Payments are made monthly to Chernobyl survivors and war veterans.
    3. DEMO (Additional monthly financial support). Awarded to war participants and military pensioners for special services.
    4. Payment for travel on intercity transport.
    5. Reimbursement of funds used to pay for utility services.
    6. Compensation for amounts used to purchase medications and treatment in resort-type organizations.

The above payments can be issued to the relatives of the deceased if this opportunity is fixed at the regional level.

lost pension of a deceased pensioner

If a military man or war participant dies

In this case, relatives have the right to receive the lost pension only if they organize a funeral at their own expense. To apply for a subsidy, you must provide a certificate issued by the municipality, which will confirm the fact of the funeral. The money is accrued by the Ministry of Defense. Widows have the right to subsidies and benefits due to the deceased.

For registration you need to prepare:

    • a certificate issued to a military person or a participant in the Great Patriotic War,
    • certificates of registration of marriage relations and the fact of death of the spouse,
    • a certificate reflecting information regarding family composition,
    • passport.

Recently my mother’s husband, my stepfather, died. He was a military man and had been receiving a military pension for several years. It so happened that he died on December 1st. That is, he was not paid his pension for December. I heard that some pensions can be received after the death of the pensioner. Can my mom get this money?

        Yulia 02/06/2017 at 11:10

Yes, indeed, after the death of a pensioner, you can receive all types of insurance coverage, as well as military and funded pensions. However, this is only possible if the funds were not paid in the current month before the death of the citizen.

Your case is just like that. Your mother can contact the military registration and enlistment office (since military personnel receive support through the Ministry of Defense) if she lived with him and was his legal wife. To do this, she must submit the following documents within 6 months from the date of his death:

      • a corresponding application (the form is available on the official website of the Pension Fund of Russia);
      • passport;

    • husband's death certificate;
    • Marriage certificate;
    • confirmation of the fact of cohabitation (certificate from housing authorities, copy of registration certificate, etc.);
    • work book and military ID.

My father, a pensioner, was an individual entrepreneur. Two months ago he died. Shortly before his death, he re-registered the IP in my name. That is, it turns out that he himself became unemployed. I recently learned that funeral expenses can be reimbursed. Is it so?

    answer

      Yulia 02/13/2017 at 11:12

Yes, you can submit a corresponding application within six months from the date of your father’s death and receive social benefits for funeral expenses. Since your father was not employed on the day of his death, in order to reimburse the costs you need to submit all the documents described in the article to the territorial body of the Pension Fund of the Russian Federation.

This benefit is paid on the day you apply for it and has a maximum amount, which from February 1, 2020 is 5562.25 rubles. If you live in areas with difficult climatic conditions, the payment amount may be increased in accordance with regional coefficients.

Hello! Our mother recently died. She was disabled group 1. My father wanted to apply for the last pension he had not received, but it didn’t work out. The fact is that the parents’ marriage was concluded in the Kazakh SSR. During the move, the marriage certificate was lost. When the pension was issued, my mother issued a duplicate of this certificate in the registry office where they were registered, that is, in Kazakhstan. The document was written in Russian, but the blue stamp is in Kazakh and the note “repeated” is also in Russian. The pension fund demanded a notarized translation of this seal into Russian. Do Pension Fund employees have the right to do this, because it is very expensive? And where should we do this? We live in the countryside. Is there really no other way to get your pension? Sincerely, Irina.

Hello. Tell me, my mother is a pensioner, she took care of my sister, who is disabled, the care was officially confirmed by the Pension Fund of Russia (more than 60 months), the sister died. Can a mother receive her sister's pension instead of her own?

    answer

      Edward 08/23/2017 at 19:06

No, she cannot receive her pension instead of her own. Moreover, if you mean monthly or compensation payments for care, then they should only be made by able-bodied people who have no income (i.e. if your mother received a pension and was simultaneously caring for her sister, then such a period may not be officially counted ). Therefore, your question is not entirely clear. If your mother was granted a pension after the death of her sister, then when calculating the pension, periods of care should have been included in the length of service, for which 1.8 points are awarded for each full year of care.

Hello! 2.5 months ago my father passed away, a notification came from the Pension Fund of the Russian Federation stating that I, as a legal successor, have the right to payment, since he had not reached retirement age. I submitted an application and received a refusal due to the fact that the savings were in a non-state pension fund. I applied to the NPF, but when my father got a job, the HR department incorrectly indicated my name in the will, the fund said “you are not the only one with this situation and the case will win in your favor.” I filled out the application again, I was notified that I should receive a refusal indicating the reason and with this refusal I should send a package of documents to the court. A month has passed, the refusal has not yet arrived, I called the NPF and they told me that the refusal will come within 7 months. The question is: are they deliberately delaying the refusal or is this the case, the case is obviously a losing one or should we wait for the notification and go to court?

I called the Pension Fund then and they told me that I was not eligible. Children and grandchildren only. Her grandson (my son) was small at the time. The Pension Fund of Russia said: when he becomes an adult, let him apply. Now my son is 21 (the only heir of his mother-in-law). How do you know if you should go to court? Frequently asked questions

Citizens who have lost a loved one have many questions regarding the procedure and conditions for receiving the deceased’s pension.

Can a wife receive her husband's pension?

The law does not allow you to simply receive your spouse’s pension instead of your own.

Transfer of rights to a subsidy is possible if:

    • the spouse was dependent on the deceased,
    • the marriage was registered,
    • the spouse renounces her pension in favor of the deceased’s accruals.

Is a pension due after the death of a pensioner?

    What is inherited

Only the cumulative part can be inherited. However, if a person died without cashing out insurance accruals for the current month, then the lost pension of the deceased pensioner will also be paid to relatives.

Savings are paid only if a person died before the day the subsidy was assigned or after the appointment of an urgent or lump sum payment, without having time to receive it. A permanent pension is not inherited. The successor can write a waiver of the pension, as well as any property included in the inheritance.

To whom is the funded portion paid?

A citizen has the right to bequeath his savings. In this case, the legal successors will be those persons whom the deceased indicated in the application regarding the distribution of funds. He also states the shares in the document. A citizen who has no family ties with the pensioner can become an heir upon application.

In the absence of a will, the subsidy will be received in equal shares by the heirs of the first priority:

    • children (both natural and adopted),
    • spouses,
    • parents and adoptive parents.

There may be no relatives of the first stage, then the right passes to the heirs of the second stage.

The heirs of the second stage include:

    • sisters and brothers,
    • grandchildren,
    • grandparents.

If someone else is to blame for the death

If the death of a loved one occurred as a result of actions taken by third parties, the perpetrators are obliged to compensate for the damage. The amount and procedure for transferring funds is determined by a court decision.

    Sberbank rules

In a situation where the deceased opened a deposit with this credit institution before June 20, 1991, relatives should contact the bank branch. According to the rules, in this case, a payment of 6,000 rubles is made to the heirs.

receiving a pension after the death of a pensioner

Will they give it to a distant relative?

The designated category of citizens receives the right provided that there are no persons closer to the deceased. In this case, the presence of relationship must be documented.

    If the deceased lived separately

Relatives are interested in whether a pension is due after the death of a pensioner if he lived alone. In such a situation, the pension must be included in the property transferred by inheritance. Inheritance is carried out on a general basis.

Is it possible to receive a pension of a deceased citizen?

Every citizen of the Russian Federation who has reached the age of incapacity automatically acquires the right to financial security in old age.

The amount is calculated individually and provided to the pensioner monthly by transfer to a card or delivery in person.

In the event of the death of an elderly citizen, the financial support due to him in the current month, but not paid, does not expire.

According to the law, the lost pension is provided to his immediate relatives. In fact, the funds are transferred to the family of the deceased.

However, the norm applies only to the amount of pension that was not received by the person due to his death.

As for subsequent pension payments, relatives no longer have any rights to them, because the only legal recipient has died.

In this case, there are no longer any grounds for accruing security, as well as no reason for providing it to third parties.

    Other death benefits

In some cases, relatives are entitled to payments after the death of a pensioner, in addition to the pension. This could be alimony, social benefits, amounts for damages.

    Funeral benefit

In order to take advantage of state assistance in the matter of funerals, you must take charge of organizing them yourself. Any citizen can do this, that is, not only those related to a deceased relative.

The amount of money will be paid to the applicant provided that the pensioner was not employed. Otherwise, the payment is transferred to the Social Insurance Fund.

To receive money, you must send an application to the Pension Fund within six months. If the deceased was a military man or a disabled person during the Great Patriotic War, then the application is submitted to the Ministry of Defense. Payment is made on the day of registration of the application. The amount of the subsidy as of 2020 is 5,701.31 rubles.

You must provide the competent authority with:

    • statement,
    • passport,
    • a paper from the registry office confirming the fact of death,
    • certificate of absence from work,
    • certificate from the Social Insurance Fund (if required).

If the relatives wish, this benefit can be replaced by organizing a funeral free of charge.

Is a pension due after the death of a pensioner?

    Survivor's benefit

Citizens who have lost their breadwinner are entitled to one of the following pensions:

    • insurance (if there are funds in the pensioner’s account),
    • social (if the deceased was not employed),
    • on state support (provided for civil servants, as well as the military).

For relatives of military personnel and astronauts, an additional insurance or social payment or long-service pension is provided.

    The survivor's pension is intended:

    • minor children,
    • disabled family members,
    • spouses,
    • full-time children under 23 years of age,
    • parents,
    • relatives who took in the care of a deceased child under 14 years of age,
    • grandchildren, brothers, sisters, grandparents.
