Conditions for assigning an insurance pension

An old-age insurance pension is assigned when the conditions established by Art. 8 of the law of December 28, 2013 No. 400-FZ, as amended. from 06/27/2018:

  • reaching the age of 55 years for women and 60 years for men (as of 2020), with the exception of civil servants, for whom the retirement age is determined separately;

Note: if bill No. 489161-7 is finally adopted, the retirement age from 01/01/2019 will be gradually increased to 63 years for women and 65 years for men.

  • insurance experience of at least 9 years (for persons applying for a pension in 2018, in the future the minimum length of service will increase annually: 2020 - 10 years; ...; 2024 - 15 years);
  • the value of the individual pension coefficient (IPC) is 13.8 (for 2020, then the size of the IPC will be increased to 30 by 2025).

Note: The Government of the Russian Federation is considering the possibility of abolishing pension points, but a draft law has not yet been developed.

The right to early retirement is available to persons whose insurance period includes periods of activity associated with special working conditions (hazardous production, underground work, civil aviation, fire service, etc.) or work in the Far North and equivalent areas (full the list of such citizens is given in Article 30-32 No. 400-FZ).

Please note: Law of the Russian Federation dated April 19, 1991 No. 1032-1, as amended. dated 07/03/2018 also provides for the possibility of early retirement (but not less than 2 years before the appropriate age) on the recommendation of the Employment Fund for women with at least 20 years of insurance experience, and men with 25 years of experience or more, laid off in connection with the liquidation of the company (termination of the activities of an individual entrepreneur, reduction of the organization’s staff), if there are no vacancies for these persons.

What will the pension increase be from April 1, 2019?

Disability pension of the Russian Federation

The indexation level announced by the government is 2.4%. In this option, the additional payment will be:

  • Group 1 and disabled people from childhood - 240 rubles;
  • second - 119 rubles;
  • third - 105 rubles.

From February 1, the EDV was indexed in the amount from 95 to 163 rubles.

Reference! In 2020, labor pensions were indexed in January, so there will be no recalculation in April.

Conditions for assigning a social pension

This type of pension can be assigned:

  • citizens of the Russian Federation who have reached the age of 60 years - for women and 65 years - for men (due to the pension reform, this criterion can be increased to 68 and 70 years, respectively);
  • citizens belonging to the category of small-numbered peoples of the North, who have reached the age of 50 and 55 years, respectively, permanently residing in the above area on the day of the pension;
  • foreigners and stateless persons who have reached the above age and have lived in the Russian Federation for at least 15 years.

There are no requirements for insurance experience when applying for a social pension.

For the loss of a breadwinner

Needed by disabled dependents - children, parents, relatives. When the deceased has work experience, insurance payments will be accrued, otherwise social benefits. The minor children of the deceased will also receive a social pension.

Attached to the package of documents:

  • certificate that the breadwinner has died;
  • papers that confirm family ties with him;
  • certificate of birth and temporary registration if a child under 14 years of age receives a pension.

Conditions for assigning a state pension

Issued to citizens affected by radiation or man-made disasters in accordance with the laws:

  • No. 166-FZ dated December 15, 2001, as amended. from 03/07/2018 – if you have at least 5 years of insurance experience;
  • or No. 1244-1 dated May 15, 1991, as amended. dated 06/04/2018 (taking into account norms No. 400-FZ) - the minimum number of years of insurance experience and the amount of the IPC are established in the same amount as for the assignment of an old-age insurance pension.

The retirement age is determined separately and depends on the nature of the work performed by citizens, as well as on the time, place and duration of residence in areas exposed to radiation contamination, but cannot be less than 45 years for women and 50 years for men.

Note: there are no plans to raise the retirement age for people affected by radiation and man-made disasters.

The concept of "age"

Of course, there are no age restrictions when applying for disability benefits. But in other cases you need to wait until you reach a certain age. Namely:

  • 60 years old – husband. and 55 years old – female. for insurance pension;
  • 65 years old – husband. and 60 years old – female. for everyone else;
  • 55 years old – husband. and 50 years old – female. from the peoples of the Far North, considered small in number;
  • 50 years old – husband. and 45 years old – women who worked in hazardous working conditions for more than 7.5 years.

The concept of "experience"

The concept of “work experience” is used when calculating pension payments and compensation. This concept is closely related to another, which sounds like “length of service,” that is, a period of continuous work. The Federal Law “On State Pension Provision in the Russian Federation” plans to increase the length of service from 6 to 15 by 2024. From 01/01/2018 The length of service has already amounted to 9 years.

The concept of "coefficient"

While a person is working, pension contributions are calculated on his salary. You can top up these contributions yourself. These are then recalculated and replaced with “points”, which can affect the amount of pension payments. The number of points is a coefficient for calculating benefits, and is closely related to the increase in the minimum length of service. The minimum required number of points will also gradually increase from 6.6 to 30.

Specific benefits

There are some categories of citizens who can receive specific benefits. For example, those who have lost their breadwinner, disabled people or their relatives, veterans of combat and military service can apply for a benefit on utility bills in the amount of 50-100%.

Procedure for applying for a well-deserved retirement

In order for the MFC to be able to calculate and make pension payments, this very retirement must be formalized. You will have to contact the territorial body of the pension fund directly.

The fund writes an application and submits the following documents (originals again):

  1. Passport;
  2. SNILS;
  3. Employment history;
  4. Military ID (for those who must have one).

Note: if the work was carried out before 2002 and this time was included in the length of service, then you must provide a certificate of average monthly earnings for as many as 60 months.

After 10 days, the pension fund issues a pension certificate. Until 2020, all pensioners had certificates, but they were cancelled. Having received such a certificate, a person acquires the status of “pensioner” and can already receive pension payments and all other related services provided by the MFC.

It is recommended to start planning your retirement in advance. About a couple of months before retirement age. It is different for men and women, 60 and 55 years old, respectively.

Who has the right to apply for a pension in Moscow through the MFC?

According to Federal Law of 03/07/18 No. 166-FZ “On State Pension Security in the Russian Federation” the following have the right to apply for social benefits in Moscow through the MFC:

  1. Disabled people.
  2. Participants, WWII veterans.
  3. Citizens who have the sign “Resident of besieged Leningrad”.
  4. Parents, widows of a serviceman who died while participating in hostilities.
  5. Minor citizens who have lost their breadwinner.
  6. Pensioners by age, length of service.

According to Federal Law dated January 21, 2014 no. 216-FZ “On Insurance Pensions”, male persons have the right to receive cash benefits in old age upon reaching 60 years of age, and female persons - 55 years of age. When calculating state financial support for length of service, the total length of service presented in the individual personal account statement is taken into account, as well as points awarded depending on the number of years worked and the amount of salary.

In accordance with the Law “On Insurance Pensions in the Russian Federation” dated December 28, 2013 No. 400-FZ, the minimum length of service for 2020 must be at least 9 years, the number of points – 13.8.

Non-insurance periods affect accruals:

  • undergoing military service;
  • maternity leave to care for a child;
  • time off for health reasons;
  • registration time at the unemployment center;
  • care for a disabled child, an elderly citizen who has reached 80 years of age.

In accordance with the Law “On Insurance Pensions in the Russian Federation” dated December 28, 2013 No. 400-FZ, a category of citizens has been defined who have the right to apply for an early pension in Moscow through the MFC:

  1. Persons who worked in the territories of the Far North and equivalent regions.
  2. Workers of hazardous, hazardous enterprises.
  3. Military personnel, doctors, teachers, educators by total length of service.
  4. Mothers of many children - more than 5 children.
  5. Disabled people of the 1st group in terms of vision, height disproportions.

For workers of the North, regardless of their current place of residence, the pension threshold has been reduced: for men – 55 years, for women – 50 years. According to Art. 11 Federal Law of 03/07/18 No. 166-FZ “On state pension provision in the Russian Federation”, indigenous residents of the polar territories have the right to receive monthly payments ahead of schedule. When moving to Moscow, preferential benefits are no longer valid.

When should you apply for a pension?

  1. Written employment contracts drawn up in accordance with labor legislation at the time of their conclusion.
  2. Work books of collective farmers, certificates issued by employers or government agencies.
  3. Extracts from orders, personal accounts and payroll statements.

All entries contained in this document must be confirmed in orders issued by the employer. Their details are indicated in the work book. The Pension Fund has the right to request copies of these orders to confirm the relevant information. This happens when discrepancies arise between the information specified in the work book and the data in the Pension Fund database.

Who will accept the documents?

Any MFC within the capital. Absolutely anyone. The fact is that registration of an old-age pension in Moscow through multifunctional centers is carried out on an extraterritorial basis, without reference to place of residence or registration. A Muscovite can contact the MFC, located near his work, near his favorite club or mother-in-law’s house.

And having chosen, do not forget to make an appointment - this will save you a lot of time and nerves. Convenience is convenience, and queues, you know, have not been canceled.

How to make an appointment

There are several options for getting an appointment at the “My Documents” MFC. Firstly, this is a personal visit without an appointment, straight to an appointment with a specialist. Appear in the electronic queue and simply wait for an invitation to see a specialist. Secondly, make an appointment by phone. Thirdly, online recording works. However, this opportunity is provided only to those citizens who have registered on the State Services portal. No proof of identity will be required. By the way, in the same MFC you can (and should) confirm your identity in order to gain full access to the functionality of the single portal of State Services.

When making an appointment in advance, a citizen just needs to arrive at the appointed time and wait for an invitation to see a specialist. The waiting period will not exceed 5 minutes from the time specified during registration. Once at the appointment, the specialist needs to submit the appropriate application (or fill it out with him) and provide the original documents.

Director of the State Budgetary Institution “Multifunctional Centers for the Provision of Public Services” Elena Gromova notes that the system of operation of the centers is quite effective. More than 75,000 citizens visit the MFC every day; this figure reaches 2,000,000 people per month.

List of documents and state duty

What documents will be required to apply for a pension at the MFC:

  • statement. You can download it from our website, print it out and fill it out in advance, or ask a consultant for help;
  • passport (for stateless persons - residence permit, temporary residence permit);
  • SNILS;
  • application for choosing a pension delivery method;
  • documents confirming length of service - time of work, service, caring for a child or the elderly, being abroad on diplomatic, trade or cultural missions, etc.;
  • documents indicating income for 2001–2002. or for any 60 consecutive months before 2001 to calculate the IPC (individual pension coefficient). Certificates from the employer or from the archive are suitable;
  • documents evidencing the right to early retirement;
  • power of attorney for the representative and his passport, if the applicant does not apply in person;
  • other documents confirming special circumstances.

The application form was approved by Order (Administrative Regulations) of the Ministry of Labor No. 14N dated January 19, 2016. The pension recipient fills out:

  • name of the territorial administration of the Pension Fund;
  • your full name, SNILS number, citizenship;
  • addresses by permanent and temporary registration, actual location;
  • telephone for sending notifications and prompt communication;
  • passport and biographical information;
  • information about the representative;
  • type of payments (survivor's pension, disability, old-age, insurance, state, funded);
  • information about other biographical, family facts, attitudes towards military and civil service, employment, the presence and number of dependents, etc.;
  • a control question and a secret word that will be used by the applicant in telephone communication with a Pension Fund employee (necessary for prompt resolution of issues regarding the assignment and amount of a pension);
  • list of documents (their names and details);
  • method of information (e-mail, telephone);
  • signature, transcript and date of submission.

There is no state fee for reviewing an application for a pension.

Deadlines

The Pension Fund makes a decision within 10 working days from the date of receipt of all required documents. Registration of a pension at the MFC can take up to 16 working days: 3 days are given to the Center’s employees to transfer the application to the Fund and to issue the result to the citizen.

The period may be increased if the citizen has submitted documents on work experience or income before 2002. Their verification suspends the issuance of old-age pensions and other payments for a maximum of 3 months. The applicant receives an SMS or email notification about this.

The pension is assigned from the moment the application and documents are received, but not before the right to it arises.

Waiting for the result

Having accepted the application for an old-age pension and other payments, the MFC employee issues a receipt to the citizen. This document contains:

  • application number by which you can track the status of the application on the MFC website;
  • date of admission;
  • list of documents;
  • Full name of the employee, his signature, seal.

An MFC employee makes copies of documents, certifies their authenticity and sends them to the Pension Fund.

The Pension Fund creates a model of the pension file: checks all submitted documents, calculates the amount, and, if necessary, makes changes to the individual personal account. The citizen receives notifications about the successful receipt of an application for a pension through the MFC and the results.

Waiting period

The legally defined period for consideration of a citizen’s appeal when establishing a pension is 10 working days. But you should understand that documents are transferred to the Foundation from “My Documents”. Therefore, it may take a little longer to process your application.

However, this will hardly affect the citizen, since the date of assignment of the pension in any case will be the day when the citizen submitted the documents to the MFC. But difficulties may arise if some information needs to be clarified. Firstly, you will have to “deliver” the necessary papers to the Pension Fund Client Service at the place specified when contacting “My Documents”. Secondly, this must be done within 2 months. Otherwise, the date of assignment of the pension will be shifted to the moment when all the necessary papers are received by the Pension Fund.

If a citizen is refused a pension, it will not be sent to the MFC, as many expect, but to the citizen personally. This is done by post to the place of residence indicated when applying for a pension. A copy is sent to the “personal account” on the unified government services portal and to an email address. The refusal can be appealed to a higher authority, through the prosecutor's office or in court.

Choosing a suitable pension delivery method

When drawing up an application for cash payments, a pensioner at the MFC indicates the method of delivery of funds. While receiving monthly benefits, you can change this method by writing a corresponding application. You can receive money:

  • To a bank account and card;
  • Through the cash desks of the Russian Post;
  • Through third-party organizations that offer, among other things, home delivery of pensions.

Receipt of money in the last two cases occurs upon presentation of a passport and power of attorney, if the money is taken by another person.

Pension calculation

It is impossible to independently calculate the amount of future benefits. To obtain approximate information, on the website of the Pension Fund in the section “Personal Account of a Citizen” -> “Pension Calculator” there is a form for calculating payments. However, registration on the site itself is not required to access your account.

The calculation will require data on length of service, amount of income, as well as additional factors that may affect the size of the final amount, for example, the number of children or military service.

When calculating yourself, you can get an approximate amount by multiplying the coefficient (points) by its cost. The value of points changes annually. For example, in 2020, 1 point is valued at 81.5 rubles. To the amount received, you can add payments to the old-age insurance pension, which is about 5,000 rubles. The final result should approximately coincide with what the system calculates on the Pension Fund website. However, final payments are made directly to the Pension Fund after submitting the application.

What is SNILS and why is it needed?

SNILS stands for Individual Personal Account Insurance Number. This number is a combination of 11 digits of the form 123-456-789-12, unique for each citizen. The word SNILS also refers to a green card containing the specified number and information of the owner - full name, date and place of birth. This card is also called a “Certificate of Insurance” and must be kept by its owner.

Why do you need SNILS? It is required:

  • to form a pension;
  • to simplify the receipt of all kinds of government services, in particular, through the website gosuslugi.ru;
  • when applying for a job;
  • when applying for benefits;
  • in many other situations.

If you or your child do not have SNILS, we highly recommend getting one! Life will become noticeably easier.

Reasons for refusal

After the 2020 reform, the requirements for pensioners began to become stricter. Applicants for the insurance part of the old-age benefit in 2018 must have 13.8 points and 9 years of work experience. Every year these numbers are growing.

The reasons for refusal to issue a monthly pension payment are:

  • insufficient insurance experience;
  • lack of pension points.

The first means that the person worked unofficially or was simply not employed. And the second indicator may be associated with low official wages.

These two indicators must be officially confirmed, and this may also be associated with a refusal to issue a pension. Disadvantages that do not allow a correct assessment of work experience:

  • errors in work book entries, lack of signatures and seals;
  • incorrect reporting by the enterprise for a specific person;
  • when recording in the work book, the employer did not pay insurance premiums for his employee;
  • lack of data in the city archive of the liquidated enterprise.

Another reason for refusal to apply for a pension through the MFC may be imperfect legislation. For example, teachers can retire early after working long enough to do so. A nanny who worked in a kindergarten for 25 years was denied this right. Because the list of positions that fall under this benefit includes only a junior teacher. Although the nature of the activity is identical, due to a different job title in the work book, the nanny cannot begin receiving pension payments ahead of schedule.

Each case of refusal is individual and is subject to discussion or requesting additional documents from the archives. But sometimes the only option may be litigation. The claim, along with copies of documents, is filed with the district court. Along with this, you will need to pay a state fee of 300 rubles.

Terms and cost of registration

When applying for a pension through the MFC, you do not need to pay any state fees. The entire procedure is free of charge.

If all necessary documents have been submitted with the application, the period for consideration of the application will be no more than 10 days.

Attention

The start date of payments is the day the papers are submitted. If retirement age has already arrived and there has been no application to the Pension Fund, there will be no accruals for this period. The exception is filing an application within a month after leaving work.

You can submit documents to apply for state benefits through the MFC without waiting until you reach retirement age. But their consideration will begin only after the date of the legal period.

Appealing the result

A future pensioner has the right to file a complaint against the action/inaction of the Pension Fund of the Russian Federation, its division or a specific employee in any form.

But at the same time it must indicate:

  • The name of the organization or its employee whose actions are subject to appeal.
  • Full name, address and other contact details of the author of the appeal.
  • A list of actions to apply for a pension that the applicant is protesting.
  • Arguments and arguments in favor of reconsidering the outcome.

The complaint is submitted to the MFC, Pension Fund or its representative office in person, through an authorized representative or by e-mail and is subject to mandatory registration.

If there is no opportunity and competence to resolve the complaint, it is forwarded to the authorized body for its further consideration no later than 3 days after its receipt with mandatory notification to the author of the appeal.

For consideration of the application, from 5 to 15 days are provided, depending on the circumstances specified in it, as a result of which a verdict is made to satisfy the complaint regarding the assignment of a pension or to refuse it. The response is sent to the author no later than the day following the day the decision was made.

Which centers deal with pension issues?

It should be taken into account that not all multifunctional centers are engaged in processing pension payments, but only those that have an agreement with the pension fund.

Therefore, before visiting a local MFC you need to choose:

  • clarify whether the center provides the necessary service;
  • select on the MFC.RF website the nearest branch where you can be guaranteed to submit an application for the assignment of security;
  • clarify information by calling the MFC hotline number 8.

Reference! Of the 115 centers in Moscow, only 36 deal with pension registration.

Design nuances

If a citizen has not worked, he is entitled to a social pension, which can be issued 5 years after reaching 65 years for men, 60 years for women. If an individual is registered at the unemployment center, monetary compensation is paid up to the age limit. The last type of security is assigned by the Pension Fund. If there are minor citizens at the time of retirement, a dependency allowance is due.

If a citizen began to apply for a pension at the MFC 30 days after dismissal due to the maximum age, it is possible to recalculate the monetary support from the period of termination of employment.
